Managing Counsel, Privacy & Data Protection

Coral Gables FL Managing Counsel, Privacy & Data Protection The candidate will provide proactive mentorship on privacy and data security issues across legal and compliance teams to drive partnership, knowledge-sharing and efficiency. Will serve as a legal subject matter specialist and advice on standard methodologies across all aspects of privacy and data protection law and regulation. Support growth of new business opportunities by analyzing the privacy implications of new data-driven products and services, specifically in the areas of data analytics and fintech, and providing mentorship on minimizing privacy compliance risk, and as needed, conduct risk assessments related thereto. Monitor changes in applicable privacy laws; prepare updates and connect with internal clients to keep them abreast of these developments. Respond to privacy and data protection-related inquiries from a wide range of groups across the company and providing significant advice and legal counsel regarding the same. Advice on the potential business impact of GLBA, HIPAA, CCPA, GDPR, proposed NIST Privacy Framework and other global privacy and data security laws and regulations. Draft, develop, implement and maintain privacy policies, procedures, notices and guidelines. Draft and negotiate privacy and data protection-related provisions of commercial and technology contracts, including data usage and license agreements, vendor/service provider agreements, customer agreements, data transfer and data protection agreements. Creatively build upon and drive awareness around privacy and data security issues. Provide strategic direction and leadership to cross-functional teams including business Operations, Marketing, Procurement, IT, HR and other partners. Develop guidelines, training and tools to support accountability and compliance across the organization.

The candidate should have Juris Doctor or LLM from an accredited law school. (In good standing with the State Bar with no disciplinary record.). Must have a STEM background. Must have 8+ years experience with at least 4 years in a global corporate legal department, with a substantial focus on data analytics. Experience with technology, digital media and fintech is required. CIPP strongly preferred. Must have strong interpersonal and team-building skills. Must have strong organizational skills and the ability to prioritize and to juggle multiple tasks. The ability to influence beyond authority in a sophisticated and matrixed organization is required. Must have strong speaking, writing and negotiating skills and good attention to detail.

Miami FL Vice President & Assistant General Counsel - Privacy & Information Security Responsibilities: Manage a cross-functional committee that sets policies for responsible use of data and oversees an effective data management/information security system. Coordinate with senior management to establish effective, practical controls, including auditing practices, with respect to data collection, management, and storage. Establish and maintain a system for training Univision's employees and contractors and ensuring adherence to policies for responsible use of data. Conduct privacy impact assessments to analyze risks in new or changed business activities. Provide negotiating and contract drafting support to Univision business units that manage customer data. Remain current in legal requirements and best data management practices, resources, and technology solutions, including active engagement with other privacy professionals. Co-chair a cross-functional incident response team with respect to data breaches. Coordinate with senior members of Univision's Legal and Communications teams to respond to inquiries from regulators, enforcement agencies, and data protection authorities. Coordinate with Univision's Communications team and business units to articulate Univision's privacy principles, including regular review and updates to Univision's internal and external privacy policies and practices.

Qualifications: JD Degree. Current license to practice law in at least one state; eligible to practice in New York or Florida. 7+ years of legal experience, with 3+ years in privacy. 5+ years of practical experience with digital technology. Significant expertise negotiating and drafting commercial contracts, especially with respect to terms and conditions governing consumer data. Desired: IAPP certification or deep knowledge of United States privacy laws and regulations. Demonstrated ability to manage privacy and information security incidents and matters. Proven experience articulating and managing privacy and information security across an organization with a number of different business models.
