Corporate Privacy And Regulatory Counsel

Holmdel NJ Corporate Privacy and Regulatory Counsel Responsibilities: Understand, interpret, and apply current domestic and global privacy laws and regulations, and other laws and regulations, applicable to ' business and long-term plans. Work closely with the different areas of the business to provide strategic and proactive legal advice on regulatory matters, strategies, and product designs. Collaborate with legal department colleagues and the business on various legal and regulatory issues, with an emphasis on privacy, information security, and other regulatory compliance. Assist in implementing updates to policies and processes for the business to address legal and regulatory requirements, including domestic and global privacy, bribery, and marketing and communications. Assist in driving compliance through drafting, reviewing, updating, and helping to audit and enforce internal policies and procedures, as well as, conducting various compliance training workshops. Assist in conducting annual privacy and regulatory compliance risk management assessment and driving compliance related corrective action and remediation plans. Assist with litigation matters, as necessary. Mentor other team members. Conduct research on a variety of legal issues and act as an expert on several key areas. Consistently ensure that business is conducted with integrity at all times and that behavior aligns with policies, procedures, and core competencies.

The candidate should have Bachelor's Degree and Juris Doctor from an accredited law school. Member in good standing with any state Bar in the United States (and willing to become a member of the New Jersey Bar). Should have 5+ years of legal experience at a law firm or government regulatory agency or in an in-house role. 7+ years of related experience is preferred. Experience with US and foreign privacy laws required. Specific desired experience includes such privacy laws as the Fair Credit Reporting Act, Gramm-Leach Bliley Act, Telephone Consumer Protection Act, the Canadian Personal Information Protection and Electronic Documents Act, the European Union Data Protection Directive, General Data Protection Regulation, Massachusetts Standards (201 C.M.R. 17), California Online Privacy Protection Act. Familiarity with US and foreign employment and marketing laws also would be beneficial. Experience in researching and analyzing state, federal, and foreign laws and regulations. Ability to analyze case law and provide recommendations. Strong communication and interpersonal skills. Strong customer orientation focus and success in creating a superior Customer Experience. Ability to effectively communicate orally and in writing with the Management and Executive Team, and company employees. Proficient in the MS Office Suite.

Vice President, Corporate Counsel (Cybersecurity and Privacy)

Newark NJ Vice President, Corporate Counsel (Cybersecurity and Privacy) The candidate will report to the Chief Counsel for Cybersecurity and Privacy who reports to the Vice President and Chief Regulatory Office. Will lead significant cybersecurity investigations in conjunction with the cybersecurity investigative teams. Provide legal advice to the Chief Information Security Officer, Chief Privacy Officer, cybersecurity operations center and investigations teams, and work with global corporate partners to prepare and respond to cyber incidents. Advise on security and privacy-related technology issues, including the use of online websites and advertising, mobile devices and applications, and social media in compliance with laws, regulations, and self regulatory guidelines. Provide advice concerning information security and privacy incidents and compliance with state and federal breach notification laws, including evaluating whether notice is required, drafting individual and regulatory notices, and interacting with state and federal regulators. Provide advice on international data security matters relating to cybersecurity and privacy investigations to support company's multi-national business units. Follow and keep apprised of information security and privacy legal developments. Understand and interpret existing and proposed federal and state privacy laws and regulations, including the ability to evaluate and draft legislative proposals and language. Review contracts and agreements for inclusion of cybersecurity and privacy provisions. Participate in cybersecurity tabletop exercises. Provide briefings to executives on cybersecurity matters. Maintain relationships with law enforcement and regulators.

The candidate should have a J.D. degree with 7-10 years of experience in a law firm, prosecutor's office or an in-house corporate law department with emphasis on cybersecurity and privacy. Strong knowledge of federal and state information security laws, regulations, and regulator guidelines including GLBA, FCRA, HIPAA, state financial/insurance privacy laws, and state security breach laws is required. Technical cybersecurity knowledge of networks and systems, and the means used by hackers to defeat security a strong plus. Experience investigating and prosecuting cyber and white collar investigations at a US Attorney's Office or District Attorney Office would be a distinct positive. Experience interacting with regulators on cybersecurity and privacy matters is needed. Experience managing outside counsel is essential. Financial services/insurance industry experience preferred.
