Legal Counsel - Employment and Labor Relations Law The candidate will report to the Senior Legal Counsel, Employment and Labor. Will provide practical and timely labor and employment legal advice, counsel and support to company's diverse businesses in North America and Canada. Defend the company in labor and employment related claims filed with state and federal agencies and oversee outside counsel in litigation proceedings. Provide extensive day-to-day legal counsel and advice to HR and management on a variety of labor and employment related matters, including workplace investigations, discrimination/harassment claims, FMLA and other protected leaves, ADA reasonable accommodations, employee relations including discipline and terminations, wage and hour issues, background checks, drug testing, separation agreements, layoffs, employment agreements, restrictive covenants/confidentiality agreements, workplace violence, unemployment, and data privacy. Manage and evaluate outside counsel in execution of strategies in employment claims and litigation, including class actions, and provide creative approaches to dispute resolution and represent company in connection with EEOC and State employment charges. Assume responsibility for a large volume of work with reporting responsibility to Senior Legal Counsel. Serve as a key member of the Legal and Human Resources organizations to help identify and manage legal risks. Provide practical strategies, training and counsel for risk avoidance to the business units and plants. Provide legal counsel during national and interim union negotiations and other collective bargaining activities as well as neutrality/card check campaigns. Provide support for the integrity hotline and internal investigations working with Vice President, Compliance and Ethics. Provide legal advice and counsel to procurement personnel relative to reviewing, drafting, negotiating and complying with contractual terms and conditions, including federal contracting requirements, indemnification or similar legal protections in third party contracts, purchase orders or similar agreements covering non-employee workers (particularly arrangements with staffing, personnel and outplacement providers and vendors), and job bids.
The candidate should have a law degree from an accredited US law school and be a member of the Bar. Must have 5+ years of experience in a major law firm handling complex labor relations and employment matters and/or similar in-house experience. Should be an experienced attorney with the requisite legal background. Must have litigation experience in employment cases, NLRB proceedings, administrative hearings and arbitration. Should have a working knowledge of all aspects of labor and employment law.
