Counsel 2 - Privacy and Data Protection - The candidate will be analyzing and applying federal and state laws and regulations related to privacy, especially financial privacy contract drafting, including: structuring, negotiating and drafting contracts involving information security, privacy, and HIPAA matters. Will be creating and maintaining contract templates and playbooks to mitigate legal and business risk in the substantive areas listed above, and to improve the efficiency and effectiveness of legal contract support. Building strong relationships with clients to ensure the contracting process generates positive client experiences and goodwill. Analyzing contract terms, corporate policies and guidelines related to financial privacy. Supporting business groups in marketing campaigns, affiliate sharing arrangements and joint marketing relationships that use or collect personal consumer information. Drafting consumer notices and disclosure related to privacy and information security matters. Researching and providing advice related to federal and state data breach notification laws and regulations. Advising risk and compliance managers in the above areas, and supporting them in the development of practical operational processes that control risk and ensure compliance.
The candidate should have 2+ years of experience as a practicing attorney. Active State Bar membership is essential. Virtual leadership experience with ability to effectively drive results, provide feedback/direction, and manage and build relationships with leaders and team members in a geographically dispersed team environment is desirable. 2+ years of recent and continuous relevant legal experience working in the law department of a financial services company or in a law firm s financial services practice group is desirable. Strong contract drafting skills, including substantial experience with contract provisions related to information security, privacy and HIPAA is desirable. Experience in providing guidance on privacy implications of new and emerging technologies, particularly technology related to mobile banking and mobile payments is desirable. Excellent presentation skills that gain the trust and confidence of clients, including senior business leaders, and other members of the Law Department is desirable. Skilled with gathering information in a fast-paced business environment, understanding business needs and goals, and working toward effective, practical, and timely legal solutions is desirable. Excellent verbal, written, and interpersonal communication skill is desirable. Should have extensive knowledge and understanding of research, counsel, and guidance on complex legal questions or inquiries. Strong attention to detail and accuracy skill is essential.
