Litigation Counsel Responsibilities : The candidate will be responsible for providing general legal services, including litigation, subrogation, and other legal assignments, and serving as a litigator for all company issues in accordance with guidelines established by the company. This position may have direct reports. In order to effectively fulfill this position the incumbent must be in contact with Senior management, officers, regulatory agencies, professional associations, outside company counsel, opposing counselors for providers and subscribers, consultants, members, and various courts. Participates in litigation, arbitration, administrative proceedings, and dispute resolution, including, but not limited to, preparation of pleadings, trial and appellate briefs, negotiations between the parties, the conduct of trials and hearings, and all other court, arbitration, or dispute resolution appearances, and high level legal research and analysis in numerous areas of law and policy, often involving novel and complex issues, and coordinates the efforts of outside counsel in order to most effectively represent the interests of the company. Handles defense of the company, represents the company as plaintiff, handles worker s compensation matters, employment related matters, subrogation, garnishments, bankruptcy, and other legal issues. Handles routine motions, arbitrations, bench trials, and basic jury trials. Promotes the ethical and professional practice of law while interacting with other company attorneys, customers, litigants, members of the bar, members of the judiciary and their staff and others while engaged in the practice of law on behalf of company. May prepare, negotiate, and evaluate contracts and other legal documents associated with transactions for the company, including health care provider services, high-tech procurement, leasing, outsourcing, professional services agreements, delegated entity contracting, administrative services only agreements, reinsurance and stop-loss contracting, risk management and risk sharing agreements, to contractually mitigate risks and protect the competitive interests of the company. Handles general legal matters including but not limited to drafting, editing, analyzing, and implementing documents, such as legal memos, contracts, insurance policies and benefits, implementing Healthcare Reform, administrative agency regulations and other federal and state laws, serving as legal counsel on various internal and external committees, to maximize the company s strategic position in the marketplace. Advises senior management of the legal ramifications of proposed corporate strategies, resolution of corporate legal issues and legislative and regulatory developments, and proactively identifies and communicates exposure and risk in order to position the company as the preeminent health care company.

Requirements : The candidate should have a J.D. degree from an accredited law school required. Must be licensed to practice law in Louisiana. Must be in good standing with the Louisiana State Bar Association. Minimum of five(5) years of litigation experience in the courtroom, preferably in insurance defense. Strong background in electronic discovery preferred. Demonstrated leadership skills through supervisory or management experience, preferably in the health insurance industry preferred. Must have superior advocacy skills and high ethical work standards. Knowledge of state and federal laws in relevant fields required. Must have broad, general legal knowledge, extending beyond the insurance, legal, and regulatory fields. Working knowledge of relevant PC software, including Microsoft Office products is required. Ability to effectively utilize available technology. Excellent analytical, research, organizational, management, negotiation, communication, and interpersonal skills are required. Must be a critical and strategic thinker, sound decision-maker and problem solver, have exceptional negotiation skills, and have the ability to multi-task with tolerance and success. Must be self-motivated and have the ability to motivate others. Must have the ability to work with others. Must be willing to promote and support department and company projects and strategies. Travels up to 10% of time, as required to meet business needs.
