Litigation and Compliance Counsel Attorney The candidate will provide legal advice and service by combining skill in litigation with sound business reasoning and knowledge of objectives of the company assigned business units. Will supervise and actively direct outside counsel. Work closely with investors and outside counsel to ensure adherence to regulatory policies and client objectives. Use business and legal judgment to balance an appropriate level of risk against the business needs in a particular situation. Operate within the framework of allowable corporate behavior and legal and regulatory compliance. Draft/review discovery, settlement agreements, pleadings and briefs. May analyze legislation that impacts the company and assist the company in responding to inquiries from government agencies. Prepare and manage a litigation budget. May plan, guide, oversee the performance of legal support staff. Provide support for the Compliance Department and operations generally. Help to ensure compliance with all applicable state and federal laws impacting the mortgage servicing business. Work cooperatively with the Compliance Department to keep up to date with all changes to the laws and advising the business of changes in a timely manner. Provide legal advice and guidance to operations.
The candidate should have JD Degree. Must have licensed to practice Law in State/Jurisdiction in the United States. Should have2-5 years of experience in the mortgage industry. Knowledge of federal and state laws impacting mortgage servicing such as TILA, ECOA, FCRA, FDCPA, RESPA, the Fair Housing Act, the Homeowners Protection Act, predatory lending laws, state foreclosure laws and the U.S. Bankruptcy Code is required. Superior legal research, drafting, writing and organizational skills are asset. Ability to develop legal strategy and proactive strategic thinking are preferred.
