Senior Counsel, Employment & Benefits The candidate will serve as legal advisor to business partners on topics relating to traditional labor, employment and compliance issues. Provide legal counsel with regards to applicable federal, state and local employment and labor laws. Provide legal advice involving the organization's compliance with international, federal and state privacy laws regarding human resources processes and transactions. Provide input into the development and application of human resources policies and procedures. Develop and present training and serving on multi-discipline project teams related to all of the above areas. Represent the Company in connection with state/federal agency audits and administrative proceedings (e.g. NLRA, EEOC, DOL, OFCCP etc.). Manage labor arbitrations for Refining, Midstream and Lubricant union-represented facilities. Provide guidance and legal support in connection with collective bargaining and strike preparation. Manage employment and benefits litigation including pre-suit communications and settlements. J.D. degree from a law school accredited by the American Bar Association and currently licensed to practice law in Texas or other appropriate jurisdiction required. 10+ years of work experience required. Extensive knowledge and legal experience with regards to issues and laws pertaining to privacy obligations and rights, confidentiality, non-compete agreements, HR policies, employment, labor, compensation and benefits preferred. Prior litigation experience, as well as experience handling governmental agency investigations and charges (Department of Labor, EEOC, NLRB, etc.) preferred. Superior mediation, negotiation, advocacy and presentation skills, as well as mature judgment and discretion preferred. Effective utilization and communication with internal support staff including assigned paralegal and administrative assistant preferred. Excellent written and oral communication skills required; ability to effectively manage and communicate with internal business clients and outside the Company with opposing and outside counsel, experts, witnesses and vendors preferred. Ability: to work independently within broadly defined objectives, being able to perform job functions without extensive supervision; to learn quickly and apply Company policies, procedures, operations and industry practices; to prepare and present clear, concise and persuasive oral/written opinions, reports, correspondence and presentations required. Close consultation: with business management; with other members of the Legal Function required.
