In-House Attorney - Labor and Employment The candidate will be responsible for providing legal counsel for employment related items for the company North America. Advise and analyze risk on employment law matters, including hiring, termination, discipline, accommodation, leave, wage and hour compliance, etc. Manage appointed counsel, including identifying the appropriate legal support, negotiating fees and controlling legal costs. Advise and support HR Managers in a timely and useful manner in response to specific needs and inquiries. Prepare and deliver training on employment and labor issues to Country and HR Managers on a variety of topics in a timely and useful manner in response to specific legal needs and inquiries. Provide guidance on, drafting and review of Employee Handbook and related policies and procedures. Advise and support the company Executives in a timely and useful manner in response to specific legal needs and inquiries. Support and participate in HR/Compliance investigations where there is a high risk of litigation. Responsible for Company awareness of US and Canadian legislation affecting employment and labor issues for the business. Assist General Counsel and Legal Team with other matters, as they arise. Law Degree and admission in to State Bar and 8-10 years of in-house counsel experience including contracts, litigation management, employment and labor legal issues required. Experience in providing labor, employment, benefits and immigration advice to a variety of internal Human Resources personnel; including Payroll and Benefits Departments, Senior Management and/or other legal counsel as needed required. Experience in labor, employment and benefits litigation, arbitration, mediation, grievances, unfair labor practices, workers compensation, and general administrative claims required. Knowledge of core labor and employment laws and regulations, with specific knowledge of Texas, Louisiana, California and Canada jurisdictions a plus. Experience in conducting acquisition due diligence a plus. Understanding of legal and policy issues related to payroll and tax withholding, unemployment insurance, health insurance, and 401k plans required. Experience: in claims and dispute negotiation and settlement; in drafting and negotiating employee and organized labor agreements, contracts and other legal documents, including confidentiality and non-compete, agreements, memoranda on legal research, and severance agreements; with employee benefits and knowledge of benefit systems, including operating in a diverse environment, coordinating the services of external legal advisors and attorneys on claims required. Excellent attention to detail with a pride taken in producing timely, accurate and well laid out documentation; verbal and written communication skills required.
