Environmental Counsel The candidate will work closely with the Chief Environmental and Real Estate Counsel providing legal support to the Company on a wide variety of environmental matters, including regulatory compliance (air, water, waste, TSCA, REACH), remediation, Superfund, transactional and litigation. As a secondary role and to the extent feasible, the position will also include providing legal support to the Company's corporate real estate function. Independently provide legal support to internal clients on a wide variety of environmental regulatory and compliance matters, Superfund and remediation. This will involve not only counseling clients with respect to environmental compliance, but also representing clients before federal, state and local governmental agencies in connection with permits, administrative permit appeals, responding to notices of violations, compliance orders, cleanup orders, etc. Independently provide environmental legal support in an M&A and transactional setting in drafting and negotiating environmental reps, warranties, indemnities, and environmental liability allocation provisions in stock, asset and real estate purchase and sale agreements. Assist the Department s litigation group with respect to litigation matters that have an environmental focus (e.g., toxic tort, cost recovery, etc.). As a secondary role and to the extent feasible, the position will also include providing legal support to the Company's corporate real estate function with regard to sales and purchases of real estate, leasing (both as lessor and lessee), easements, licenses, access agreements, listing agreements, etc. Substantial knowledge and experience with federal, state and local environmental laws, rules and regulations required. Law degree (JD) from a law school accredited by the American Bar Association (ABA), and a member in good standing of the bar of a State, a Territory of the United States, or the District of Columbia required. 7+ years of experience as an environmental lawyer in a law firm and/or as in-house counsel required. Ability and strong desire to work independently with very minimal supervision in exercising discretion and independent judgment as a team leader who often sets strategy and direction for addressing a wide variety and number of environmental matters required. Excellent analytical, writing, and communication skills required. Substantial knowledge of environmental laws and regulations, and the ability to apply that knowledge in a diverse setting comprising of environmental compliance, administrative, Superfund, remediation, transactional and litigation matters preferred.
