Data Privacy Counsel The candidate will assist the Chief Privacy Counsel in ensuring compliance with global data protection laws and regulations (in particular, the GDPR). Will be responsible for developing and enhancing the Company's global privacy programs. Be responsible for supporting customer-facing privacy inquiries (especially for HIPAA) and for assisting with data governance initiatives. Conduct privacy by design and data privacy impact assessments (DPIAs). Attend product development sessions, capturing personal data design information and providing related advice; conduct data privacy threshold and impact assessments. Customer-facing HIPAA support. Support commercial imaging business, including handling customer requests related to applicability of HIPAA and for security risk assessments. Assist in developing and maintaining data governance structure for new and existing products and business processes. General and commercial data privacy responsibilities. Assist with: research and advice on global privacy laws, regulation, and guidance; development and implementation of data privacy policies and procedures, and related training and guidelines for monitoring internal compliance; and transactional (contracting) privacy issues with customers and vendors.
The candidate must have excellent academic credentials. Should have a Juris Doctorate. A CIPP Certification. Must have 3+ years of legal experience, including US privacy and data protection experience, preferably from within a major international law firm or multinational corporation. Knowledge of the US (especially HIPAA) and EU (especially the EU Directive 95/46/EC and the GDPR) privacy and data protection laws; a focus on clinical research, healthcare data, data analytics and/or SaaS technology is strongly preferred. Data governance experience with the use of technologies to ensure privacy protections on the use, collection and disclosure of personal data; monitoring systems development and operations for security and privacy compliance; conducting privacy impact assessments and ongoing compliance monitoring activities essential. Business-focused data privacy / data protection experience needed. Prior experience with data privacy and data security requirements for SaaS technology essential. Experience working at a software or technology company, or in the pharmaceutical industry is needed. Experience leading privacy initiatives, including demonstrated track record of drafting and implementing policies and procedures, and in designing and implementing effective training programs is essential.
