Labor and Employment Counsel The candidate will interface with members of the company s executive, fulfillment, operations and HR teams, at headquarters and the company s fulfillment centers throughout the country, including in California, to manage and execute on a broad range of employment practices initiatives in the areas of recruiting, hiring, benefits, compensation, performance, discipline and separations, internal investigations, leaves of absence, employee relations, discrimination, harassment, workplace privacy, wage and hour compliance, restrictive covenant compliance, contingent and temporary worker matters, regulatory compliance and employment matters risk management, among others. Serving as the subject matter expert in all areas of federal and state (including California) labor and employment laws, including Title VII, FMLA, NLRA, ADA, FLSA, ADEA, WARN and OSHA, among others. Ensuring compliance with all applicable federal, state and local employment practices laws, rules and regulations. Providing strategic legal counsel and risk management advice to management and HR and executing on a wide variety of HR and employment practices matters, including in respect of recruiting, hiring, benefits, compensation, performance, discipline and separations (voluntary and involuntary), internal investigations, leaves of absence, employee/labor relations, discrimination, harassment, workplace privacy, wage and hour compliance, restrictive covenant compliance, contingent worker matters, regulatory compliance and employment matters risk management. Conducting internal investigations in respect of allegations of violations of company policies and labor and employment laws, managing employee complaints, grievances and disputes, interpreting and providing guidance on employment-related contract provisions, enforcing restrictive covenant compliance, supporting the company s positive employee relations initiatives, supervising union organizing campaigns to the extent necessary, drafting and negotiating a variety of employment-related agreements, and responding to all manner of inquiries from management and HR relating to labor and employment matters on a daily basis, among other activities. Leading the Legal team s efforts in the preparation, implementation and refinement of best-in-class labor- and employment-related practices, policies, guidelines, tools, programs and forms that align with the company s employee engagement strategy, values and business goals. Preparing and conducting regular employee and management trainings on relevant matters, and managing company training programs in conjunction with HR. Representing and defending the company as necessary in front of applicable federal, state and local regulatory and enforcement authorities, including NLRB, EEOC, OSHA, state FEPAs, CalDOSH, NYDHR and other governmental employment agencies, and against claims or charges brought against it in federal and state court, arbitration and governmental proceedings. Monitoring and assessing the impact of legal and regulatory developments and enforcement trends at a state and federal level. Counseling management and HR on new or pending federal and state legislation, laws, rules and regulations and industry developments and trends that affect the company and its operations. Efficiently managing outside counsel with an eye toward minimizing outside counsel expense and meeting budget. Providing substantive support for the rest of the Legal team as needed, including strategic transactions. Engaging in or leading various other Legal projects and duties as needed.

The candidate must have JD degree from a top law school with exceptional academic credentials and 9-12 years of relevant experience gained at a leading law firm and in-house (ideally at a large manufacturing or CPG company) in roles of increasing responsibility. Should be admitted, active and in good standing with the New York State Bar.
