Employment Counsel The candidate will provide support, assistance and legal advice to the bank and its holding company and affiliates on a variety of employment practice topics, including: discrimination, harassment, performance management, employee discipline and separations, workplace investigations, wrongful discharge, severance programs, leave of absence, accommodations, recruiting, hiring, benefits, wage and hour, immigration, compensation, employment agreements, unemployment, and workers compensation. Employment Counsel will support senior counsel and work independently on various initiatives, projects, and litigation and non-litigation matters. Employment Counsel will work with the Human Resources team on developing and maintaining policies and procedures related to workforce management in all of the bank s markets. Advises the bank with respect to employment matters and compliance with applicable federal and state laws and regulations, particularly in Arizona, California, and Nevada. Keeps abreast of legal decisions, statutory changes and other developments. Manages the bank s actual or potential employment litigation and ADR matters, including controlling outside legal expenses. Advises and supports internal personnel investigations. Assists with various complex and/or sensitive projects, as assigned. Drafts or reviews policies, procedures, compensation plans, and other employment related documents. Drafts and negotiates agreements with independent contractors, and assists in the appropriate classification of third party service providers. Consults on immigration issues, as needed, working with human resources staff and outside counsel. Advises on legal risks associated with various business strategies. Effectively communicates and builds rapport with clients, coworkers and colleagues; has strong analytical and problem solving skills combined with attention to detail and thoroughness. Possesses strong organizational skills and the ability to handle high volume and balance competing demands. Has good judgment, a high level of professional integrity, discretion and tact. Participates on strategic teams to develop and achieve company objectives. Works on a wide variety of issues and legal requirements applicable to a publicly traded company. Assists other in-house attorneys on legal projects as needed. Oversees non-attorney staff as necessary to ensure the delivery of quality legal services.

The candidate should have Juris Doctor from an accredited law school. Active license to practice law in Arizona or other U.S. jurisdiction is needed. Should have 3 years of relevant experience in private practice or in-house. Must have advanced knowledge of state and federal employment and labor laws and regulations. Should have knowledge in some or all facets of the following: corporate and contract law, litigation, and federal securities laws. Must have excellent written communication skills. Should have advanced ability to review legal research, analyze and summarize findings as necessary.
