Associate Counsel Employment The candidate will investigate and respond to Charges and Complaints of discrimination which are filed with federal and state administrative agencies across the country. Manage employment arbitration cases. Regular travel throughout the continental U.S. is required. Partner with Human Resources to investigate allegations of discrimination in all federal and state discrimination and retaliation Charges and complaints. Manage the EEO charge investigation process including: gather pertinent documents, analyze data, and interview witnesses related to allegations of discrimination filed with state and federal agencies. Respond to notices, subpoenas, summons, demand letters and other correspondence that require legal action in the employment and human resources arena. Assist with EEO fact findings, on-site investigations, mediations and pre-determined settlements. Assist with managing the defense of employment litigation/arbitration matters, including supervising outside counsel. Prepare and submit position statements to all federal and state EEO and retaliation Charges. Provide supplemental information to federal and state agencies as requested. Maintain EEO Charge files. Draft and ensure document retention letters are disseminated for all EEO Charge files. Maintain EEO reporting spreadsheets. Identify compliance issues uncovered during investigations and explore possible solutions with appropriate business partners. Provide legal advice and counsel to the company. Remain current on changes in employment law (both federal, state and local). Liaise with outside counsel when needed.
The candidate should have J.D. from accredited law school. Ideal candidate must have 5 years experience in EEO investigations and litigation. Must be admitted to practice law and a member in good stating of a state Bar. Previous experience in employment law is preferred. Diverse Human Resources or operations experience is desired. Should have strong oral and written communication skills. Must have precision to detail with strong follow-up skills. Should have strong legal writing skills with the ability to draft position statements and correspondence. Must have ability to define problems, collect data, establish facts and draw valid conclusions. Should have ability to handle investigations and negotiate settlements.
