Corporate Counsel, Privacy The candidate will be responsible for drafting and reviewing data privacy policies and procedures, negotiating data security and privacy provisions, performing privacy assessments and analyzing privacy issues, performing broad scope statutory reviews, monitoring changes to the regulatory landscape, and designing and implementing privacy compliance controls. Will coordinate and liaise with various business functions to ensure compliance with applicable laws, rules and regulations, maintain sufficient data privacy and security controls, assess privacy impact of business strategic and developing programs, facilitate and enhance training programs, and educate business clients on privacy requirements and partner with relevant stakeholders to develop compliance guardrails. Works directly with Privacy Officer and business stakeholders to draft, review and implement data privacy policies and procedures regarding the proper collection, use, protection, process and sharing of personally identifiable information. Reviews privacy initiatives and activities to ensure compliance with privacy laws and regulations, as well as organization policies and procedures. Negotiates data security and privacy provisions in a wide variety of commercial transactions. Collaborates with key stakeholders in various business units on privacy issues, liaises with various business units to stay abreast of programs with privacy implications, educates business stakeholders on privacy policies and procedures, facilitates program development, and ensures privacy consideration is embedded in the program design stage. Works with Privacy Officer to lead the effort of data incident response preparedness, coordinates with a cross-functional response team on practicing the plan, and improves the plan maturity. Handles data incidents in compliance with applicable laws, regulations and Company policies and procedures. Identifies and evaluates known and potential privacy risks and compliance risks across the Company and its subsidiaries, develops and operationalizes proper controls to mitigate the risk, and conducts ongoing compliance monitoring to ensure compliance. Conducts and/or coordinates privacy impact assessments, provides privacy-by-design guidance, and develops and implements recommended strategies and plans. Advises on data privacy and security risks, and advises on the procurement and maintenance of appropriate cyber liability insurance coverage. Administers the design and implementation of privacy-related processes and procedures throughout the enterprise. Evaluates the impact of U.S. and international legislative, regulatory, legal developments and industry guidelines involving privacy and security, advises the Company on responding strategies, and operationalizes legal requirements to practical implementation suggestions. Responds to customer, employee and regulatory privacy and data security inquiries and requests. Provides counsel and collaborate with litigators on privacy-related enforcement actions and litigation. Exhibits creativity and innovation in recommending improvements to department or enterprise practices and processes. Should have JD degree. Must have 3-5 years of relevant professional experience. Should preferably be Certified Information Privacy Professional (CIPP/CIPM) Certification. Must have extensive experience with communication privacy laws (such as CANSPAM, CASL and TCPA) as well as best practices and industry self-regulatory codes related to online advertising and social media. Should have experience in directing data incident investigations and remediation efforts, including breach notices. Must have knowledge in the European Union s and Canadian data protection laws. Experience in working in a corporate law department is needed.
