Employment Law Assistant General Counsel II Duties: Provide legal advice and identify risks and benefits of human resources policies, processes, and decisions including issues regarding both employment compliance and contracting. Provide legal advice on general employment law related matters, including but not limited to, human resources issues, wage and hour laws, employment benefits, employment services agreements, FMLA, ADA, employment discrimination, and other state and federal claims. Prepare and advise on terms of various employment and professional services agreements. Provides legal advice and identify risks and benefits non-compete agreements and policies and practices regarding outside activities. Draft, review, and edit legal documents as requested or assigned by the VP/Deputy General Counsel or EVP/General Counsel and perform other duties including matters involving the cross section of employment and health law. Provide legal advice in the development and interpretation of corporate policies and programs related to employment law. Draft and edit policies, procedures, guidance and other employment-related documents. Directly support members of management to ensure that each member of management making a human resources or employment decision fully understands the risks associated with the decision. Work with outside litigation counsel to development engagement standards and billing practices to minimize legal costs. Assist to protect Moffitts legal interest and maintain its operations in compliance with applicable law. Provide hands-on legal counsel support to all levels of management. Identify and analyze legal issues, draft key documents, present clear recommendation and assure legal compliance. Provide VP/Deputy General Counsel and EVP/General Counsel with recommendations for retention of outside counsel, engagement terms with outside counsel, and budgeting related to the retention of outside counsel. Retain, manage, supervise, direct, and work with outside counsel retained by on all legal matters. Have direct responsibility and oversight for a broad range of litigation and potential/pre-litigation related to employment, liability, contract disputes, healthcare, and other issues. Keep current on new and emerging laws and policy developments regarding human resources, employment and labor law, especially in the health care business environment. Draft institutional policies in accordance with best practices and within the bounds of applicable laws and regulations. Receive and investigate inquiries and issues related to legal matters such as human resources and employment law compliance, licensures, and applicable policies. Direct and participate in the research of state and federal legislation and administrative and court decisions; investigate legal problems and make recommendations. Provide other legal support as directed or as circumstances may require to support management and protect legal interests. Supervise and manage the legal work of in-house paralegals, attorneys as well as outside counsel in support of the OGCs legal and administrative functions. Provide legal advice and identify risks and benefits on human resources and employment procedures, policies and practices, including related compliance and contracting matters. Identify and analyze legal issues, drafting key documents, presenting clear recommendation and assuring legal compliance. Initiate routine meetings with departmental leaders to provide legal advice, recommend updates to practices and procedures to meeting developing legal requirements and support compliance. Support contract management efforts of the VP/ Deputy General Counsel and EVP/ General Counsel. Prepare, review and negotiate other business transactions. Research and special projects assigned by the VP/ Deputy General Counsel and EVP/ General Counsel.

Qualifications: MD/DO-JD Degree. Must be licensed to practice law in the State of Florida and have 16+ years of experience practicing law. Senior level experience with human resources and employment legal matters is required, including employment discrimination and non-compete agreements. Excellent negotiating, interpersonal, business, contract drafting, and writing skills are required with a minimum of 8 years of related general litigation management, compliance regarding employment, labor, and human resources, as well related contracting activities. Significant private practice experience and experience supervising and managing paralegals and support staff for maximum efficiency is preferred. Experience with human resources and employment law matters in a health care context including these involving a cross-section of employment and health law preferred. Should be able to display excellent organization, problem-solving and computer skills. Should have excellent research, written and verbal communications as well as public speaking skills. Needs to have positive attitude at all times, robust attention to detail, strong work ethic and ability to maintain confidentiality. Ability to read, analyze and interpret general business contracts professional agreements, technical procedures, or governmental regulations. Ability to write reports, business correspondence and procedure manuals. Ability to effectively present information and respond to questions from groups of managers, faculty, customers and the general public. Mathematical Skills: Ability to add, subtract, multiply and divide in all units of measurement, using whole numbers, common fractions and decimals. Ability to compute rates, ratios, and percentages and to draw and interpret bar graphs. Reasoning Ability: Ability to interpret a variety of instructions furnished in written, oral, diagram or schedule form. Knowledge of the Internet and Microsoft Excel, Word and Outlook software. The best candidate will also have in depth administrator level experience with contract management systems. Preferred: Florida Bar Board Certificate.
