Privacy Counsel The candidate will provide responsibilities include: Advising the business on privacy matters concerning product development and strategy, marketing, data use and governance, and risk. Serving as a key subject matter expert and adviser to firm lawyers, and advising key functional areas and regional business units on data privacy requirements regarding new and enhanced consumer and merchant products, services, technology, marketing communications, data use, and new business initiatives. Helping to ensure adherence to global privacy and data protection laws, while enabling the development and execution of business initiatives. Coordinating with regional lawyers to evaluate and, where appropriate, help design products, services and technologies for compliance with local data privacy regulations. Working with Compliance colleagues, the Global Privacy Office and firms Data Protection Officer (DPO) to develop enhance and implement the firm Global Privacy Framework in markets where firm operates. Advising on new and emerging legal and regulatory developments impacting data privacy and data security, including identifying trends and potential impacts on the businesss activities. Providing training to legal colleagues to help them advise their clients on how to design products and services that comply with firms Privacy Principles and reflects organizational privacy and security requirements. Understanding and advising on the privacy and data protection legal requirements applicable to complex data flows across the data life cycle. Collaborating and coordinating with government relations teams to proactively monitor and review privacy and data-protection related legislation in order to ensure accurate and up-to-date inventories of all legal obligations. Support commercial negotiations, as needed, driving to a risk-based and pragmatic resolution of outstanding privacy and data protection aspects of strategic partner, merchant and/or vendor agreements.

The candidate must have 7+ years of experience practicing either in-house (or in an equivalent setting) or at a reputable law firm. Must have Juris Doctorate or equivalent degree. Must be admitted to a state bar. Must have exceptional writing skills, with attention to detail and ability to generate creative original drafted documents. Must have excellent communication and presentation skills; ability to communicate and help non-experts understand applicable regulations and requirements. Experience advising clients in the financial services, mobile payments, and internet and technology industries is preferred. Relevant technical certifications, such as a Certified Information Privacy Professional (CIPP) or other relevant certifications are preferred. Must have in-depth knowledge of cutting-edge IT, web, mobile, and payment ecosystem technologies (especially those used in the collection, storage and analysis of data) and privacy and data security implications. Must have familiarity with, and strong interest in, financial services technology, mobile and alternative payments, as well as emerging technology. Must have deep, demonstrable privacy, data protection, and program management skills and expertise, with an emphasis on financial privacy law. Specific experience with privacy data protection laws, including GLBA, CCPA, CAN-Spam, GDPR, e-Privacy Directive, and other applicable laws is required. Must have ability to thrive in a fast-paced environment and to tolerate change and ambiguity.
