Senior Counsel - Employment Duties: Function as an employment and employee benefits matter expert. Stay current with all applicable legal and regulatory requirements. Provide practical and sound legal advice and counsel to Human Resources and management on all legal issues concerning the employer/employee relationship in the U.S. and Canada, including but not limited to hiring, employee relations, leaves of absence, performance management, discrimination, harassment, wage and hour, immigration, non-competes and other restrictive covenants, termination, reductions-in-force, separation agreements, compensation, benefits, diversity and learning and development. Advice and counsel will be on day-to-day issues occurring in the field operations as well as strategic and systemic initiatives. Provide legal advice to the Human Resource employee benefits group, including but not limited to review and revise health and welfare SPDs, notices, and annual enrollment materials for compliance with legal requirements; support Human Resources on ERISA fiduciary and retirement benefit issues; and Develops and maintains core competencies on field operations business practices. Regularly visits field operations and works onsite as needed. Develop, draft and negotiate comprehensive employment, consulting, separation and settlement contracts and agreements. Respond on behalf of KDP to attorney letters and agency matters, including charges and government-initiated inquiries and audits. Draft responses; interview and prepare witnesses; engage with agency personnel and outside counsel. Working closely with HR and management, direct and coordinate employment-related investigations; make recommendations regarding appropriate corrective action. Develop and conduct training for HR, management, and employees. Develop, strengthen and sustain productive and collaborative working relationships with HR personnel, management and staff. Participate on departmental teams to improve process, efficiency, developmental and engagement efforts.

Requirements: Law degree from an ABA accredited law school and licensed to practice law in at least one state. 8+ years of experience practicing employment law (counseling), in-house employment counsel experience required, preferably for a large company with sites in multiple states. Strong command of employment laws, regulations and best practices (including ADA, FLSA, Title VII, ADEA, state FEP statutes, Canadian employment laws, ERISA and FLSA); a passion for the subject that fosters continuous improvement and ongoing subject matter expertise. Ability to work effectively and collaboratively with clients, external entities and counsel. Excellent written and oral communications, client relations, organizational, leadership and project management skills; business acumen; razor-sharp attention to detail and accuracy. Excellent analytical skills and the ability to present findings and persuasively render diplomatic, practical, creative and at all times compliant advice in a timely fashion. Ability to organize and prioritize tasks, to handle high-pressure situations and short deadlines. Integrity of the highest order, optimistic outlook and unflappable demeanor. Team player and strong partner orientation. Ability to apply knowledge of multidisciplinary business principles and practices to achieve successful outcomes in cross-functional projects and activities. Performs other duties as requested by management.
