Senior Real Estate Counsel The candidate will be supporting the business on all real estate and construction related matters for the Americas Region handled by the Legal Department in the United States. Will be providing legal support and advice to the commercial, business development, finance, workplace services and construction teams on all real estate and construction related legal matters in the Americas. Handling US and Canada related tenancy / lease matters, concessions, project management, wholesale fit out agreements and construction matters, as well as coordinating with local counsel in Mexico and Brazil on such matters. Leading on negotiations with landlords and their advisors, utilizing strong negotiating skills, real estate market experience and reputation. Providing real estate legal advice and acting as an escalation point day to day for the internal firm teams in the Americas to find solutions to manage real estate matters (appropriately balancing firm commercial and reputational requirements). Assisting the firm business in the development, delivery and maintenance of standard lease and construction templates for the Americas and ensuring on-going compliance with current and pending legal regulation. Interpreting changes to US federal and state legislation relating to real estate matters (including States of NY and California), working with local external counsel on changes to local real estate and construction laws across all relevant US States and advising the relevant business teams on the potential implications to their function and any policy/practice amendments required as a result; ensuring these changes are communicated and implemented in a timely and effective manner across the US. Preparing, reviewing and negotiating leases, construction, concession, wholesale, and build out agreements for the Americas region as well as ancillary real estate related documentation. Managing external counsel on transactions to ensure high quality, commercially focused and cost effective legal advice. Developing and providing on-going training programs for the real estate and construction teams on all related issues in the Americas. Managing internal real estate programs and processes in order to facilitate lease review and negotiations, tracking of key terms and related data. Ensuring compliance with firm internal processes for the legal team relating to reporting to the business on IFRS16 real estate lease related matters.

The candidate should have a JD degree from top law school, must be admitted to, active and in good standing with the New York State Bar. Must have 8+ years of major law firm and/or corporate in-house experience with significant emphasis on real estate law, in particular advising retail tenants. In house experience would be desirable. Strong negotiating skills and ability to engage effectively with landlords and their advisors is essential. Understanding that legal advice goes beyond the law and has the ability to respond creatively and strategically to meet the business needs is essential.
