Immigration Counsel The candidate will consult on all aspects of employment-based immigration. Advise on established high volume immigration programs, building new immigration programs, and developing innovative solutions to complex immigration challenges. Counsel internal clients on employment-based immigration programs and solutions to secure top global talent. Serve as a legal partner to the business by understanding business needs and working with HR to find solutions that meet needs. Manage strategic advice for complex immigration matters relating to M and A, PERM labor certification strategy, and internal audit and compliance. As part of the employment legal team, develop and implement immigration legal strategies for the firm, working with human resources, compliance and policy teams. Provide strategic legal advice to HR partners and foreign national employees regarding US immigration issues, including H-1B, L-1, TN, PERM labor certification, immigrant visa petitions (Multinational Managers, Outstanding Researchers and Extraordinary Ability) and Adjustment of Status applications. Provide strategic direction to HR partners on workforce planning, job changes and employer obligations relating to immigration document requirements.
The candidate should have a J.D. degree or equivalent. 5 years of attorney level relevant experience is preferred. 10 years of experience as an in-house attorney supporting immigration strategy is required. Must be admitted to the Bar and in good standing or otherwise authorized to practice law in California. Must have experience preferably in an immigration practice with large technology clients, and specifically working on the following types of matters: H-1B, L-1, TN, PERM labor certifications, immigrant visa petitions including Multinational Managers, Outstanding Researchers and Extraordinary Ability, and Adjustment of Status applications. Global immigration experience is advantageous. Should have demonstrated ability to prioritize workflow and adjust to frequent workload fluctuations.
