Privacy Counsel The candidate will advise business on global privacy regulations with a particular focus in the EU and US. Lead privacy advisement in day-to-day and strategic commercial agreements with regard to applicable privacy law, industry organization codes, best practices, risk assessment, and diligence. Negotiate data processing agreements, data transfer agreements, and other data protection agreements. Serve as a lead privacy attorney supporting the business, product groups and the business development team to provide valuable advice on product development initiatives, or new partnerships. Develop risk assessments and determine the risk to the business of changes in data processing by the business. Monitor upcoming legislative developments on privacy globally, and develop recommendations to inform strategy with Head of Legal and other key stakeholders. Drive privacy-by-design frameworks and guide implementation of privacy risk mitigations. Be the expert resource for firm's and participate in trade organization discussions around privacy law; represent firm's in some privacy associations/ privacy working groups. Should have a thorough understanding of industry and competitors privacy profiles, policy positions, and privacy initiatives; create periodical proposals for firm's to differentiate.
The candidate must have 7-10 years of experience working at a law firm and/or in-house legal department within technology companies, preferably at a publisher, ad-tech, or marketing company focusing on privacy law and applicable impact. Should have deep understanding of evolving US data privacy laws (eg CCPA), EU data privacy and data protection regulation, as well as a good understanding of other major privacy frameworks and evolving legislation worldwide. Must have tech-savvy with a practical and advanced understanding of the digital landscape and the compliance challenges related to data collection and processing. Must have excellent judgment to make decisions on sophisticated business and technology issues. Should have ability to establish effective cross-group relationships in an international work environment and accommodate diverse personalities and cultures. Must have ability to deal with ambiguity and work in a dynamic and fast-paced environment. Must have ability to balance multiple tasks and priorities in a fast-paced environment, self-starter with an aptitude for learning and creative problem solving. J.D. from a nationally recognized law school with excellent academic credentials is required. Should be admitted to practice in good standing with at least one U.S. state bar (tri-state area preferred).
