Data Protection and Privacy Counsel The candidate will support strategic privacy initiatives and provide data protection-related contractual, policy, regulatory and compliance support to its advertising agencies, with a primary focus on the US market. Report to the Legal Director of Privacy. Provide strategic advice and direction on privacy issues across the Dentsu firm and assist with determining privacy objectives and priorities regionally, in coordination with Americas and global-based members of the Data Protection and Privacy team. Work cross-functionally with business partners to help implement and maintain the regional data privacy program, with a primary focus on CCPA and other important Americas-centered data protection legislation. Draft and negotiate a broad range of data-focused contracts, amendments, addenda, and terms relating to compliance with the California Consumer Privacy Act ( CCPA ), the General Data Protection Regulation ( GDPR ) and other global privacy laws. Counsel display advertising teams about the roll-out of data driven advertising solutions whilst ensuring compliance with applicable privacy and data protection laws. Provide data protection support and advice to the Americas legal teams identify risks and provide strategic legal advice related to data products, client services, the purchase and sale of audience data, the handling of employee data, potential acquisitions and other matters. Work closely with the Americas Legal Director of Privacy and key stakeholders to ensure alignment with the Americas and Global Privacy Team's objectives and requirements. Monitor developments and changes to data protection and privacy laws and best practice and advise on necessary organizational changes required. Participate in data protection and privacy working groups with key stakeholders to maintain visibility into privacy and data protection issues throughout the organization and provide advice to business stakeholders regarding important developments and risks. Draft and maintain firm regional privacy policies, procedures, notices and guidelines and review those of individual clients. Juris Doctorate with 1 - 3 years of experience in a role at least 50% dedicated to data privacy and within an in-house, law-firm, or consulting setting required. Should have significant experience providing advice relating to the impact of data protection and privacy in the context of IT systems, hardware, software, digital platforms, ad-tech, and/or other electronic solutions that are used in connection with personal information. Experience with domestic and international laws and regulations relating to consumer personal information (e.g., CCPA, LGPD, PIPEDA, GDPR, etc.), direct marketing (e.g., CAN-SPAM, TCPA, CASL, ePrivacy Directive, etc.), health information (e.g., HIPAA), financial information (e.g., FCRA, GLBA), childrens data (e.g., COPPA), etc needed. Certified Information Privacy Professional certification (e.g., CIPP/E, CIPP/US, or CIPM) is a plus. Must be commercially minded and have excellent communication and inter-personal skills to enable the individual to work with all levels of internal management and negotiate with external clients. Familiarity of advertising technology, marketing technology, digital/online advertising ecosystem, audience profiling/segmentation, and business to business data transfers as they relate to a media and advertising agency required. Experience in working with associations, such as 4As, IAB, NAI, and DAA, as well as major digital platforms essential. Must possess good commercial and business acumen that allows the individual to efficiently and expeditiously compare the relevant legal risks to the scope of commercial strategy and corporate objectives. Should have sound business judgment and flexibility to manage multiple wide-ranging matters, conflicting deadlines and new areas of expertise as business needs change.
