Construction Contracts Counsel - Temporary Duties: Assist in implementing systems to improve the process for reviewing, drafting, negotiating and administering a variety of contracts (Design-Build, CM at Risk, CM, Design-Bid-Build, etc.). Assist with development of written procedures for contract review and administration and notice requirements. Review, draft and negotiate prime contracts, subcontracts and purchase agreement terms and conditions, including modifications to standard terms and conditions and/or support project staff with such negotiations. Work with management to identify risk on construction projects and implement risk mitigation plans. Draft and maintain subcontract and purchase agreement templates that identify appropriate flow-down provisions. Review agreements for conformance to MWHC policies and procedures and good contracting practices. Assist local project teams to review Request for Proposal templates to incorporate applicable procurement and subcontracting requirements. Assist Business Development with RFQ/SOQ to determine bonding and insurance requirements. Work jointly with project team to implement contracting program after prime contract award. Assist project team in interface with Owner, A/E, and subcontractors to ensure appropriate subcontracting requirements are met and issues are resolved. Qualifications: Law degree from an accredited U.S. law school. License to practice in one or more U.S. jurisdictions. 5+ years of practice for a law firm or as in-house legal counsel. Experience in the drafting and negotiation of construction contracts. Ability to coordinate claims with insurers or outside counsel when claims or disputes arise that require such coordination, including the document production process. Demonstrated ability to work as member of a team and trusted client advisor. Ability to establish and maintain good rapport with executives, office management and other internal clients. Problem solving skills, including the ability to assess a situation, quickly focus on the relevant issues and create multiple solutions for resolution. Preferred: Significant construction industry experience. Ability to draft and negotiate complex and diverse construction including EPC Contracts, Design/Build Contracts, Construction Manager At Risk, construction management and leases, subcontracts and purchase agreements.
