Senior Counsel (Environmental) Duties: Works under the direction of and reports to Associate General Counsel to provide counseling and advice on complex environmental legal matters to various business units and facilities in the electricity generation, transmission, distribution, and related industries. Areas of responsibility could include providing advice concerning compliance with and monitoring and developing comments on new regulatory requirements for: Air regulatory programs and standards at utility facilities; Solid and hazardous waste management, including land disposal of coal combustion byproducts, management of used oil and other special wastes, and recycling and Reuse of various materials including poles, ash byproducts, and other used materials; Waste water discharge and wetland permitting; Emergency spill response, emergency preparedness, and associated notification and reporting responsibilities; Facility-wide spill prevention and response plans; management, storage, transportation and disposal of PCBs; and Transmission routing and compliance with federal and state environmental, endangered species, cultural and historic review. Monitoring developments in all areas of environmental law and assisting in the preparation of comments on state and federal rulemaking activities. Securing permits for various facilities and handling permit appeals. Satisfies financial assurance requirements for specific types of facilities and activities. Responds to information requests and notices of potential violation received from state and federal agencies and handles related litigation. Negotiates cost-sharing arrangements for clean-up of contaminated sites. Provides timely and accurate information to support routine financial and other reports submitted to the SEC regarding environmental liabilities. Advises on due diligence and other issues arising in the course of various transactions. Reviews environmental audits.

Requirements: JD Degree from an accredited law school. Admission to the Ohio Bar and local federal court(s); or admission to the bar of another state jurisdiction that falls within AEP's service territory (Indiana, Michigan, Kentucky, Oklahoma, Tennessee, Texas, Virginia or West Virginia), and eligible for admission to the Ohio Bar without examination, is preferred. Senior Counsel Salary Grade 10: 5+ years related environmental experience, such as environmental litigation, permitting or transactional experience in a corporate legal department, regulatory agency or private law firm. Senior Counsel Salary Grade 11: 7+ years related environmental experience, such as environmental litigation, permitting or transactional l experience in a corporate legal department, regulatory agency or private law firm.
