Compliance Counsel Duties: Performs key roles as part of the Legal and Compliance team by ensuring business initiatives and processes comply with laws and regulations applicable to indirect consumer lending model. By joining a rapidly growing company, will support a number of functional areas. Reporting to the General Counsel, will be responsible for the management of legal requirements database, advising business leaders as a subject matter expert and participating in most corporate risk management processes. Focus on legal research, licensing, corporate governance, compliance monitoring and monitoring for law changes that may impact business. Work closely with leaders in the business as well as vendors, Internal Audit, risk management and outside counsel. Support by: Leading the redesign and maintenance of compliance program; providing subject matter expertise and guidance on compliance requirements; contract review, assessing operational breakdowns for compliance risk and providing guidance on remediation/recovery plans; advising on compliance requirements, controls and monitoring of those controls; and providing guidance on identified risks. Maintain subject matter expertise of applicable laws and regulations and advise business regarding same. Maintain strong understanding of business operating processes, strategies, products and services. Lead efforts to redesign and maintain a company-wide compliance requirement program. Support business by providing expert advice and influencing changes to processes, procedures, and controls to mitigate compliance risk. Communicate and sometimes lead interactions with regulatory agencies regarding company licensing and examinations. Coordinate with the General Counsel in advising the business on compliance requirement applicability for new products and/or processes and changes in law. Review new/revised operating policies, standards and procedures. Assess operational breakdowns for legal and compliance risk and provide guidance on remediation/recovery plans. Identify trends in data and advise on emerging risks. Provide guidance on event remediation's as needed, with support from the General Counsel.
Qualifications: JD Degree from accredited law school; 2+ years of experience at a law firm or in an in-house counsel position. Certified Regulatory Compliance Manager (CRCM) certification or equivalent. Compliance, audit and/or risk management experience in a highly regulated industry. Familiarity with UDAAP, GLBA, FCRA, NACHA and related state laws.
