Privacy Counsel Duties: Provide legal advice and guidance to the DPO, senior management, business units and support functions regarding obligations under privacy laws and regulations in all US states in which conducts business, with particular reference to protection, use, transfer and sharing of personal information. Prepare privacy notices and review, advise on, draft, amend and negotiate privacy clauses in a variety of contracts. These include commercial contracts and program administration and claims handling agreements. Develop template agreements and other tools and materials. Investigate and advise on incidents and breaches involving personal information; notify regulators as required and assist with remediation; respond to requests from individuals exercising their rights for information about use of their personal information and in respect of deletion; assist with privacy impact assessments and data transfer impact assessments - all in partnership with business and corporate functions and the Data Protection team in London. Maintain oversight and administration of privacy and data protection and records retention policies and advise on disposal of records. Conduct audits of information processing activities and assess information management practices within to ensure compliance with applicable laws and regulations; monitor technical and organizational measures of third parties that process information on behalf of or in partnership. Assist the DPO to identify and mitigate privacy risks and develop and maintain compliance strategies. Support the DPO with the preparation and delivery of reports to Boards and senior management. Assist with development and delivery of know-how and training materials to staff to ensure compliance with privacy and data protection requirements in all US states in which conducts business.
Qualifications: Accredited law school graduate with strong academics. Licensed to practice law and in good standing. 4-6 years experience in a large law firm or in-house. Significant knowledge of privacy and data protection laws in the US and practical experience of giving legal advice on privacy and data protection matters. Experience with commercial contracts will be an advantage. Strong analytical skills, including ability to focus quickly on key elements of legal and regulatory risk, coupled with good technical drafting and negotiation skills. Excellent communication skills, including ability to synthesize information and communicate efficiently with a variety of stakeholders. Experience/familiarity with insurance/reinsurance preferred. Strong business acumen and responsive, service-oriented attitude. Proven ability to take ownership of projects. Flexibility and ability to multi-task and manage shifting priorities. Must demonstrate excellent knowledge and understanding of business strategies, operations and objectives and have significant experience providing advice on privacy laws, regulations, and practices to ensure personal and nonpublic information is protected.
