Compliance Attorney The candidate will provides legal counsel and advice on employment-related matters. Acts as Company subject matter expert on Office of Federal Contract Compliance Programs (OFCCP) issues. Represents and defends the company with Equal Employment Opportunity Commission (EEOC), Department of Labor (DOL), and OFCCP administrative complaints and audits. Develops and maintains a process to ensure compliance with OFCCP and EEOC regulations. Manages the data collection, development, and submission of annual affirmative action plans (AAPs) for each company location. Obtains, reviews, prepares, analyzes, and submits extensive data requirements to AAP vendor and regulatory agency. Partners with branch and corporate leaders to develop, communicate, and monitor AAP goals and initiatives. Researches and documents prevailing wage requirements and concerns. Provides advice and support to Human Resources and other business stakeholders on employment law matters (EEOC, hiring practices, performance management, leave management, etc.). Assists with the investigation of allegations of violations of company policy. Analyzes claims to determine the risk of liability and damages to the company. Reviews business practices and makes recommendations to mitigate legal risk. Prepares for the possibility of audits and investigations. Partners with Human Resources and other stakeholders on developing strategies, maintaining records, and designing procedures. Assists with preparation of discovery, including interrogatories, document preparation, and related motion practice. Researches legal issues and maintains an awareness of current federal and state laws and regulations. Assists with projects and litigation in all aspects of law. Juris Doctorate degree and admission to practice in at least one state required, with admission to the Tennessee Bar required within a reasonable period. 2-5 years of experience practicing law required. Some exposure to OFCCP, EEO, ADA, FMLA, and wage and hour issues required, Experience conducting investigations and managing e-discovery required. Litigation and/or litigation management experience required, Knowledge of OFCCP regulations and affirmative action plan development/implementation, Knowledge of federal, state, and local employment-related laws and regulations (e.g., Title VII, ADA, EEO, FLSA), Knowledge of alternative dispute resolution programs and best practices, Executive presence and relationship management skills. Influencing and negotiation skills, Excellent verbal and written communication skills, including presentations, Strong computer skills with Microsoft Office applications (Word, Outlook, PowerPoint, Excel).
