Senior Counsel, Product, Privacy, & Commercial Duties: Advise product teams as they design cutting edge products and tools, balancing commercial, marketing, compliance and privacy concerns. Answer new questions, solving uncharted problems, and working collaboratively with business teams to meet the needs of our fast-paced environment. Advise internal clients on commercial contract strategy, from start to finish. Provide thought-leadership to Etsy management on the evolution of Etsy's global privacy program, global privacy principles and implementation of our global privacy and data transfer strategy. Work to understand Etsy's business priorities and objectives, and focus your work to achieve practical and effective solutions. Act as the privacy counsel within the legal team to provide privacy guidance to multiple business areas, including marketing, product, engineering and human resources. Work with partners on data protection and privacy risk and compliance as required- e.g. providing input on any changes to privacy processes that are required as a result of new laws, counseling on privacy impact assessments. Review, draft and negotiate a wide range of US & international commercial agreements. Help improve our teams Legal Ops. Follow, enhance and develop scalable processes for all stages of the contract lifecycle. Identify, understand, manage, and explain international legal and regulatory risks related to our business. Qualifications: JD Degree and are admitted to a state bar (preferably NY or CA) and are qualified to work in-house in New York. 7+ years' experience, at both a law firm and in-house, dealing with issues related to product development for tech and e-commerce companies. A wide portfolio of technology, operational and commercial agreements, and have developed deep knowledge in some areas. Experience advising internal clients and business partners on high level marketing and product matters Deep global experience with product development issues, including web and mobile app development. Extensive experience negotiating data protection terms of technology and commercial agreements with customers and vendors globally, including leading negotiations and discussions with large companies Broad experience with global privacy laws and regulations, such as the GDPR, CCPA, COPPA; and experience with sector specific laws, including self regulatory frameworks Broad experience advising on intermediary liability considerations, Ad technologies, cookies and trackers, EU and FTC regulations, accessibility, SAAS and IaaS, open source, intellectual property protection and licensing, DMCA practices and procedures, and more. Experience being the primary point of contact with clients, and taking the lead in managing the legal side of a project. Experience reviewing, drafting and negotiating US & international commercial agreements (especially experienced negotiating indemnities, limitations of liability, intellectual property rights, SAAS agreements, etc) History of counseling clients on commercial contract strategy, from start to finish. Experience balancing sound business and legal judgment. Effective communicator verbally and in writing. Experienced speaking to technical specialists or business leaders in plain English, without legal jargon. Executive presence and are passionate about clearly articulating risk and strategies to mitigate risk to clients and executives. Attention to detail and have strong organizational skills. Excellent business, negotiation and presentation skills. Should also be able to analyze and communicate the information into a simple, effective message to others.
