Legal Counsel, Employment and Litigation Duties: Support the Assistant General Counsel, Employment and Litigation and other attorneys in the management and counseling of the employment, litigation and pre-litigation legal affairs of the Company. Represent the Company in employment and other litigation matters in front of various federal, state, and local agencies or courts including drafting position statements, propounding and responding to written discovery and subpoenas, taking and defending depositions, drafting summary judgment motions and preparing for trial. Advise corporate clients concerning all applicable laws, regulations, policies and practices that involve the employment relationship. Provide legal advice in connection with internal employment-related investigations. Provide legal advice in connection with the Company's unionized workforce including collective bargaining and unfair labor practice charges. Develop and conduct continuous training for management and non-management level employees on various legal issues (e.g., ADA, FMLA, hiring, EEO, etc.). Oversee litigation hold/preservation processes in litigation matters, including drafting of litigation hold notices. Direct and supervise outside counsel handling employment or other litigation, including devising case strategy, establishing a budget and serving as liaison for investigations, discovery, and other litigation-related tasks. Counsel operations and corporate clients on general commercial matters and regulatory compliance. Provide legal advice to operations regarding various compliance issues including customer banning, citations and subpoenas. Interpret contracts, laws, rulings and regulations and render opinions to Company management, HR professionals and other attorneys as needed. Review and negotiate contracts and other legal instruments of the Company, specifically the acquisition of technology and services, severance agreements and consulting agreements as requested by the People Team. Provide research, legal advice and other legal assistance to Company management, HR professionals and the other attorneys as needed. Support the Assistant General Counsel in maintaining complaint e-discovery and document retention policies and processes. Monitor legislative, regulatory and litigation trends in employment and commercial laws, anticipate legal risks and provide cost-benefit analysis when identifying risks. Review and draft corporate policies and procedures, including the Company policy handbook, and update existing policies and procedures as necessary.

Qualifications: JD Degree from an accredited establishment. Member of Pennsylvania or New Jersey bar in good standing. 5+ years of employment litigation experience, preferably obtained in a large law firm setting or employment litigation boutique. Experience in representing a national retailer or retail organization preferred. Experience in handling labor union matters and commercial litigation preferred. Ability to manage and resolve litigation in a way that meets Company strategies. Communicate effectively both orally and in writing. Analyze information and effectively propose solutions. Strong critical thinking, research, writing, and organization skills. Strong attention to detail and excellent follow-up. High degree of professionalism and confidentiality. Ability to effectively negotiate. Handle multiple priorities simultaneously. Work independently as well as in a team environment. Align and collaborate across organizational boundaries.
