Corporate Counsel-Transactions Duties: Provides legal analysis, advice and counsel to the Company's officers and managers concerning corporate litigation matters as well as assigned corporate, financial, regulatory, personnel, and contractual matters; actively support, as assigned, internal business departments. Advises the General Counsel of the legal risk associated with such litigation and other matters. Assures that assigned matters are handled in an effective and efficient manner, and that the legal records for which he or she is responsible are properly compiled and maintained; schedules work so that it flows evenly and steadily; follows legal department procedures. Ensures that Company-wide policies and procedures, on matters for which Attorney is responsible, are applied in full recognition of all legal implications and risks. Remains current and knowledgeable about applicable legislation, case law and administrative rulings, as well as pending legislation and administrative regulations pertinent to the Company; as assigned, provides counsel to other departments in interpretation and training so as to minimize non-compliance risks. Performs servicing functional responsibilities assigned to Legal department. Conducts research on projects as required by General Counsel. Performs such other responsibilities and duties as assigned by General Counsel.
Qualifications: JD Degree. Qualified to practice in Illinois. 5-8+ years in legal transactional work, mortgage servicing litigation and/or consumer finance litigation. Experience analyzing and responding to cases, effectively working with counsel, managing a case load and resolving cases effectively and efficiently. Prefer 5+ years of experience with a reputable law firm or within the legal department at a bank or mortgage lending company or comparable experience. Ability to prioritize work, effectively manages and interacts effectively with senior management. Ability to deal with legal issues in a practical and efficient manner; excellent analytical skills; exceptional oral and written communication skills; good interpersonal skills; ability to persuade and present positions effectively yet inoffensively; flexibility and willingness to work under pressure with tight deadlines on a large number of issues at one time; attention to detail. Preferred Qualifications: Prefer: Knowledge of federal and state laws impacting mortgage servicing such as TILA, ECOA, FCRA, FDCPA, RESPA, the Fair Housing Act, the Homeowners Protection Act, predatory lending laws, state foreclosure laws and the U.S. Bankruptcy Code. Knowledge of mortgage servicing software and platforms.
