Associate General Counsel of Advocacy, Employment Law and Litigation Duties: The candidate reports to the SVP, Ethics and Compliance, Employment Law and Litigation, the Associate General Counsel of Advocacy, Employment Law and Litigation provides a full array of legal counsel and advice on various matters. These matters include: oversees complex lobbying and political law rules at both the federal and state levels, ensures AARP, one of the largest lobbying organizations in the country, complies not only with federal law but with the patchwork of state and local laws that affect lobbying and gifts to legislators and staff, files accurate federal, state, and local lobbying reports that are often open to the public, provides advice to HR and management, responds to administrative charges and employment litigation, and manages non-employment related litigation matters, while helps determine defense strategy and works closely with outside counsel on pleadings, arguments, and case analysis. Also, reviews contracts from various departments and provides support for AARP state offices, as needed, as well as takes on special projects and works on larger projects with teams of other lawyers as they arise. Advocacy: Researches state and federal laws on lobbying disclosure, ethics, governmental gift laws, and campaign finance and drafts written guidance and training materials for organization staff. Manages regulatory filings related to state laws governing lobbying and campaign finance, with a focus on accuracy and on the impact of information being made public. Analyzes lawsuits brought against AARP and demand letters sent to AARP to determine the best course of action. Assists with or manages litigation matters, including marshaling the defense and retaining and overseeing outside counsel. Reviews, negotiates, and approves agreements, particularly for state offices. Works on a wide variety of projects, including training, research, analysis, drafting documents and memoranda, and otherwise addressing a variety of legal problems as they arise. Contributes as an active and engaged member of the Office of the General Counsel (OGC) team, helping to build camaraderie and to increase the team's effectiveness. Litigation: Analyzes lawsuits brought and against AARP and demands letters sent to AARP to determine the best course of action, including national class action suits, breach of contract, personal injury. Makes recommendations on defense strategy and marshals resources for defense, both internally and externally. Selects and retains outside counsel in consultation with the general counsel and manages outside counsel litigation billings. Issues litigation holds, manages discovery, including e-discovery, and has expertise in the use of AARP e-discovery tools. Negotiates resolution of claims with opposing counsel where appropriate. Works closely with outside counsel and oversees them in representing AARP throughout the matter, reviewing pleadings, considering options for strategies and tactics as things develop, and making settlement recommendations where appropriate. Employment Law: Supports the Employment Law function across the enterprise providing legal counsel and advice on employment law issues, including representation of AARP and its affiliates in employment litigation matters. In consultation with the SVP, Ethics & Compliance, Employment Law and Litigation, determines our defense strategy; negotiates with opposing counsel to settle matters early if appropriate; retains outside counsel; handles litigation holds and e-discovery; preps and accompanies AARP staff who are subpoenaed on behalf of AARP, marshals teams of lawyers within OGC where needed, and works closely with outside counsel on pleadings, arguments, and case analysis in cases that go forward. Represents AARP in administrative proceedings with the EEOC and state agencies. Works closely with HR staff to advise on personnel matters, employee relations issues, and internal investigations. Advises on employee benefits issues, together with outside counsel.

Qualifications: The candidate will have a J.D. degree from an accredited law school with 6+ years directly related specialized experience in the areas of advocacy, employment law, and litigation. Must be, or be able to become, a member in good standing with the District of Columbia bar or other state Bar. Excellent oral and written communication skills. A comfortable public speaker with the ability to make formal presentations to management and to provide engaging, clear, training for new managers and other staff who may have a minimal legal background. Good judgment, sensitivity to people and what motivates them, good negotiator and mediator. Ability to function independently with limited guidance. Must function with the highest degree of integrity and ethical standards. Passion for our nonprofit mission is a definite positive. Ability to handle multiple, high-level complex projects at one time and high volumes of work on an ongoing basis, with strong attention to detail. Demonstrated ability to collaborate within OGC, as well as with colleagues across the enterprise in an extremely complex organization. Ability to gain internal respect and build consensus with all levels of staff. Must be customer-oriented, approachable, responsive, and engaging.
