Chief Compliance Officer General Counsel REPONSIBILITIES: Serve as counsel advising the organization on corporate compliance and legal strategy. Exercise primary responsibility for the selection, evaluation, retention, and use of outside legal counsel and oversee the assignment of work to outside laws firms. Coordinate with the CEO or his/her delegate on the composition and delivery of responses to state regulatory agency complaints and inquiries. Stay current on the 340B Program compliance. Oversee the negotiation, drafting, and implementation of a wide variety of complex, multi-party agreements, including strategic alliances and joint ventures, physician affiliation agreements, vendors, and business associates. Maintain the effectiveness of the Companys Compliance Program. Develop and deploy effective communication and education regarding the Companys Compliance Program. Review contracts for regulatory risk and compliance; draft contracts that meet regulatory requirements. Conduct an annual risk assessment and develop a work plan to address key risk areas. Coordinate response to incidents with Company's insurance carriers and develop measures to mitigate risks. Perform research, serve as an internal consultant, and provide guidance on compliance matters to employees and management including the business office, coding, physician contracting, fraud & abuse laws, Medicare/Medicaid regulatory requirements, or other compliance-related subject matter. Implement and oversee activities designed to monitor high-risk areas such as coding, billing, physician contracting, screening of employees and contractors, and other areas vulnerable to compliance risk. Manage budget, resources, and staff. Lead, mentor, and develop talent within the compliance staff at both corporate and clinic levels. Addressing and managing multiple issues simultaneously.
Qualifications: Juris Doctor. Licensed to practice law in at least one jurisdiction. Certified in Health Care Compliance. Should have 10 years of experience as a practicing lawyer in regulatory or corporate law. Experience managing compliance in a healthcare setting and corporate functions as well as experience with cost-effective management of outside legal resources. Exposure to and/or familiarity with the following areas of law is a must; health care, M&A, real estate, HIPAA/HITECH, contracts, intellectual property, compliance, regulatory, employment, and general business law. Corporate governance exposure or experience is a plus. Leadership experience in a multi-location organization with a distributed workforce. Experience interacting with a Board of Directors or similar governing body. Demonstrated experience as an Advocate for Health Care or Human Rights. Fluency in a language in addition to English (Spanish preferred). Demonstrated achievement as a strategic leader in driving risk management and legal strategies that support the business imperatives of a high-performance, high growth organization. Strong interpersonal skills including ability to work well with legal and business teams comprising multiple departments. Strong communication, legal research and writing skills including ability to concisely and effectively communicate with operational, managerial, and executive team members. Ability to handle complex legal matters, analyze legal issues, draft legal documents, and use sound legal judgment. Ability to perform a variety of assignments requiring considerable exercise of independent judgment.
