Data Privacy Counsel Duties: Research, interpret and advise on international, federal, and state legal requirements related to data privacy, data protection and data transfers and recommend practical methods of compliance. Translate complex data privacy and security laws and regulations (e.g., GDPR, HIPAA CCPA, proposed NIST Privacy framework, etc.) into technical and operational legal requirements. Research and advise on legal obligations related to a potential data privacy breach. Serve as contact internally on legal issues related to privacy and data protection programs. Support the Data Protection Officer (DPO) and Manager, Data Privacy and Governance in the development and implementation of a company-wide privacy program, including advising on privacy policies, privacy protocols, GDPR and HIPAA compliance plans. Advise the DPO and Chief Information Officer (CIO) with respect to management of the Incident Response Program and other inquiries regarding privacy or security. Draft and negotiate privacy and data protection agreements, business associate agreements. Support the company's expansion internationally by (i) analyzing privacy, data protection and other data transfer laws in each new country the business enters, and (ii) advising the Company on the necessary processes, policies and documentation to implement upon entering each new country. Advise on privacy and data security matters in connection with onboarding customers, vendors, partners, and international employees. Advise on legal issues related to digital initiatives such as its website, email, text, social media, and mobile applications. Support DPO in responding to privacy and data protection-related inquiries from a wide range of groups across the company and providing advice and legal counsel regarding same. Monitor changes in applicable privacy laws; prepare updates and trainings for internal clients to keep them abreast of these developments. Bring privacy and data legal issues and concerns to the attention of General Counsel and DPO. Proactively look for solutions and better practices for mitigating risk related to data privacy and security.
Qualifications: Juris Doctor degree from an accredited law school and a member in good standing of the Colorado Bar or the Bar of the supreme court of the state in which he or she practices. Should preferably have 5 years of legal practice with a combination of law firm and in-house experience. Must have 2-5 years of experience with global privacy programs, with corresponding knowledge of global privacy laws and practices; preferably in health care or other highly regulated sector. Between 2-5 years of experience advising clients on HIPAA, CCPA and other state and federal privacy laws and regulations. Strong command of technology, IT operations, cloud computing, and software/mobile application development process. Proven ability to apply legal principles to new and evolving technologies. Proven track record of exercising excellent judgment on behalf of clients in complex legal and organizational matters. Demonstrated discretion handling sensitive and confidential information. Excellent written and oral communications skills in public and private settings with diverse audiences; ability to translate complex legal issues for a lay audience. Strong interpersonal skills, able to collaborate with team members, staff, customers, clients, government officials and external audiences. The ability to work with minimal supervision in a pro-active manner in a fast-paced environment. Healthcare industry experience preferred.
