Associate General Counsel - Labor/Employment Law DUTIES: Represents the Corporation in labor and employment matters that involve or could involve proceedings before federal and state courts, administrative agencies, and arbitration tribunals. Representative matters include: discrimination and harassment claims, accommodation and accessibility cases (employment and public access), pay equity claims, family and medical leave claims, Railway Labor Act disputes and business immigration cases. Supervises outside counsel retained to represent in adversary and other proceedings or for advice, in order to ensure that such representation is effective and cost-efficient. Advises the Executive Vice President, General Counsel & Corporate Secretary, Senior Managing Deputy General Counsel, Deputy General Counsel (Labor and Employment) and senior management, in particular in the Human Resources department, relative to legal considerations inherent in a variety of operational, commercial and internal matters, in order to ensure that the corporation makes business decisions and adopts policies and practices with full knowledge of applicable legal considerations, and specifically with respect to federal, state and local labor and employment laws, including Title VII, state EEO and wage and hour laws, FMLA, ADA, COBRA, ERISA, ADEA, USERRA, RLA as well as U.S. immigration laws. Develops and conducts training for management employees, on topics such as FMLA, ADA or EEO responsibilities, to ensure that complies with all such laws and regulations. Supervises or conducts internal investigations and provides advice on ethics compliance within a corporate environment. Operates within budget and maintains cost controls to ensure effective utilization of resources.
QUALIFICATIONS: Juris Doctor from an accredited law school with a current, in good standing license to practice law as an attorney under the laws of any state and the ability to waive into the District of Columbia Bar. Should have 7 years of the law firm or in-house experience in employment law counseling and employment litigation. Experience litigating employment and/or labor proceedings before federal and state courts, administrative agencies, and arbitration tribunals. Experience advising the most senior levels of management on the full range of employment and/or labor laws. Experience providing internal training on employment and/or labor laws. Superior analytical and communication skills required, and an ability to quickly learn the fundamentals of different areas of the law. Excellent analytical, communication and negotiation skills; ability to handle quick turnarounds and work effectively with diverse in-house clients. Ability to manage and direct a caseload of 25-50 matters of varying types and complexity. PREFERRED QUALIFICATIONS: Knowledge of employee benefits, executive compensation and related laws including, but not limited to, ERISA, COBRA, the ACA, and HIPAA. Experience with establishment, implementation, and administration of all types of employer retirement plans and health & welfare benefit plans. Experience with the Railway Labor Act and other railroad-specific employment laws. Experience with business immigration.
