Privacy Counsel - Remote (663118) Requisition Number AMER24758 Employment Type Full-time Location Virtual Office, Other Job Summary As a member of the Legal Department, the Privacy Counsel will drive's compliance with privacy laws and regulations across the globe. The Privacy Counsel will advise's product and R&D teams on how to further their business goals in a manner consistent with the company's privacy standards. Principal Duties and Responsibilities Participate in new business initiatives, product development activities, and clinical affairs efforts to identify and advise on privacy considerations. Work with the Global Privacy Officer to ensure's compliance with HIPAA, GDPR, and other privacy and data protection laws across the United States and around the world. Implement the strategy of the Global Privacy Program, including creating and updating company policies and processes on the protection of personal data. Provide counsel on commercial contractual terms related to data protection and data usage. Negotiate and provide guidance about business associate agreements, licensing and distribution agreements, and mergers and acquisition agreements to address privacy-related issues and concerns. Team up with product information security team to handle customer inquiries as to measures takes to mitigate privacy and cybersecurity risks associated with its product and service offerings. Conduct privacy training programs and other awareness initiatives. Enhance systems for monitoring, auditing, and measuring the effectiveness of the Global Privacy Program. Support the processing activity assessment process to review privacy impacts of various company initiatives. Work collaboratively with other departments to mitigate privacy risks. Monitor the data request and usage processes and cross border data transfer matters for personally identifiable data across the company, utilizing mechanisms to track and report upon data usage and sharing. Assist with privacy compliance reviews, audits, and investigations. Collaborate with Company personnel, legal counsel, and other related parties to represent the Company's privacy interests with external parties (e.g., government bodies, trade associations) who undertake to adopt or amend privacy legislation, regulations, or standards. Track development of worldwide privacy regulations, including contractual and operational issues involving HIPAA, the General Data Protection Regulation, PIPL, LGPD, and other regulations and laws affecting a global medical device company, and assist businesses and regions to adapt business practices when necessary to ensure compliance. Develop external contacts and participate in professional organizations that provide benchmarks for the Global Privacy Program and allow to anticipate new trends and developments in the privacy field. Expected Areas of Competence Develops close working relationships with clients in which corporate goals and priorities are maintained without compromising legal integrity. Communicates effectively to a diverse audience, at multiple levels within the Company, through various formats, i.e. presentations, written proposals, reports, correspondence, leading meetings, face-to-face dialogue, etc. Possesses knowledge of business processes within the industry, including, product development and approval, manufacturing, marketing and selling. Understands public policy and healthcare industry developments, and the legislative and liability implications of business decisions. Demonstrated skills in collaboration, teamwork, and problem-solving to achieve goals. Demonstrated skills in verbal communication and listening. Comfortable and adept in dealing with ambiguity. Strong project management experience and skills. Demonstrated ability to operate in a complex, rapidly changing environment. Excellent writing skills. A high level of integrity and trust. Knowledge of HIPAA, state and federal guidelines on privacy, transactions and security. Advanced understanding of global privacy trends, best practices and legal and regulatory requirements, including the General Data Protection Regulation. Demonstrated ability to identify and analyze issues, and think critically to resolve problems. Ability to form solid assumptions and formulate decisions and recommendations from diverse facts and information. Familiarity with privacy compliance software platforms. Education/Experience Requirements JD required, plus a minimum of 2+ years of work experience, including at least 2 years of experience in a privacy legal role.
