Vice President and Associate General Counsel Employment The candidate provides day-to-day legal guidance and counseling on a wide variety of employment matters. Partners closely with Human Resources and Compliance in policy development, training, and investigations. Manages all employment practice litigation for nearly 16,000 employees. Independently and with little direct oversight, provides counsel to, and works closely with, Human Resources on a broad range of employment matters, including recruiting, hiring, leave and accommodation, benefits, compensation, employee relations, restrictive covenants, discipline, terminations, compliance matters (including wage and hour), and strategies for managing risk around employment matters. Fosters compliance with a wide range of employment laws and regulations, including but not limited to, DOL, Title VII, the ADA, ADEA, FMLA, FLSA, and other federal/state/local employment laws and regulations, such as those related to wage and hour matters and personnel record retention. Develops and participates in training and educational presentations. Coordinates with Human Resources to recommend, implement, and continuously improve employment-related policies and procedures. Assists Human Resources and Compliance with an internal investigation regarding employee matters and employee grievances. Recommends and helps implement appropriate actions. Investigates and manages charges of discrimination and other complaints filed against the Company with regulatory agencies. Prepares position statements and other responses to be filed with agencies prepares witnesses and participates in on-site investigations. Independently responds to and resolves pre-suit demands and attorney letters. Drafts and negotiates offer letters, severance agreements, settlements, terminations, and other employment-related agreements. Supports the continuous improvement of process and standard form agreements/contract templates, to maximize efficiencies, while providing adequate safeguards. Evaluates and monitor changing and emerging employment laws and worker classification issues through research. Manages and works closely with outside counsel in defending individual and class employment-related claims from inception to conclusion by engaging in factual investigation and discovery, and recommending effective litigation strategies, including settlement, reserve strategies, and developing annual defense budgets and exposure reserves. Reports out to management on proactive approaches to mitigating legal risk gleaned from litigation matters. Interprets and enforces the Company's policies and procedures.
The candidate should have a Juris Doctorate Degree from an ABA-accredited institution. Must have 10-15 years of legal experience. Experience in CA employment laws is highly preferred. In-house legal experience preferred. Employee Benefits experience preferred.
