Employment Compliance Counsel The candidate will provide advice and strategic support to People Services and Operations leaders across the company on a range of wage and hour compliance issues including those relating to California meal and rest break compliance, exempt and non-exempt compensation, premium pay, overtime, employee classification, alternative workweek schedules, bonuses, commission agreements, regular rate of pay, reporting time pay, payroll deductions, final wages, and other matters. May also be asked to advise on FLSA and multi-state compliance as well. Conduct or oversee counsel conducting wage and hour audits. Actively and strategically support the management of litigation involving wage and hour matters and other claims. Assist or manage outside counsel and insurance carrier representatives on a variety of potential employment law claim. Research and advise Operations leaders on a wide variety of potential employment law compliance issues that may arise from daily operations. Partner with Operations and People Services to build efficient processes to maintain compliance with laws and regulations. Draft and provide counsel on a wide range of legal documents, including, employment policies for compliance, employment agreements, separation agreements, consulting agreements, settlement agreements, and pre-litigation responses. Respond to federal and state administrative charges. Provide strategic litigation management, prevention, and mitigation. Develop creative approaches to managing legal risks and resolving disputes. Assist in the development, implementation, and enforcement of company policies. Manage and actively participate in internal and external discovery as needed. Collaborate with other members of the legal team on inter-departmental issues.
The candidate should have a J.D. from an accredited law school. Member in good standing of the State Bar of California. Should have 4 years of in-house or law firm employment law and litigation experience, with a preference for candidates with experience in management-side employment-related counseling and litigation. Experience conducting California wage audits and advising on California wage and hour compliance required. Experience defending California wage and hour claims, including single plaintiff litigation and Labor Commissioner claims, PAGA actions, and class/collective actions strongly preferred. Federal and multi-state wage and hour experience is preferred. Proven track record of delivering pragmatic solutions to novel legal problems and resolving disputes effectively and efficiently. Ability to identify, prioritize, and resolve issues quickly and independently. Strong curiosity about the business generally and a willingness to tackle a variety of pre-litigation, litigation, employment matters, and general counsel advice matters. Excellent analytical, writing, and oral communication skills. Interest in building strong cross-functional relationships.
