Insurance Counsel The candidate will perform administrative and management functions related to the legal and regulatory compliance of internal captive and other large commercial insurance products including related reinsurance, agency production, and other risk transfer agreements. Advise internal claim staff and external insurance carrier counsel on claims settlements, coverage opinions and judgments in compliance with business objectives and applicable insurance laws and regulations. Consult regularly on claims and risk management issues, policies and procedures with internal Insurance and Risk Management personnel. Initiate and support subrogation pursuits in compliance with the law and Company policies and procedures for recovery of third-party liability for damages. Prepare for and participate in complex, large exposure claim reviews. Establish, negotiate and maintain insurance vendor relationships and contracts. Support mergers and acquisitions, joint ventures, and other growth-oriented transactions by reviewing relevant insurance and corporate risk-related items. Maintain and enhance company reputation with insurance companies, brokers, courts, vendors, outside counsel, and customers. Effective advocacy on behalf of the Company in hearings, trials, and mediations. Negotiate with opposing counsel, conduct discovery, prepare pleadings, and respond to discovery and prepare and attend hearings and trials. Stay current on applicable federal and state laws related to captive insurance companies and insurance agency regulations. Maintain and protect the integrity of the company in an ethical and diligent manner. Assist the Legal Department efforts in the creation, implementation and refinement of forms, processes, policies and procedures to create efficiencies and cost savings.
The candidate should have a J.D. from an accredited law school. Attorney license in good standing and admission to the bar in at least the State of Missouri, with licensure in multiple states or willingness to obtain licensure in multiple states preferred. Should have 10 years of substantive legal experience in private practice focusing on insurance or an insurance company's legal department. A demonstrated record of experience with the insurance company and agency laws and regulations, multiple jurisdictional claims handling, and related insurance issues at federal, state and local levels. Works with others in a collaborative and solution-focused manner to achieve win-win outcomes. Ability to multi-task within a fast-paced work environment with very detailed information and maintain a high degree of accuracy. Proactive work ethic demonstrating initiative. Ability to organize, coordinate, manage self and time effectively, prioritize projects, and meet deadlines. Ability to communicate effectively, professionally, and persuasively with employees, managers, and the public, both verbally and in writing. Adaptable to growth and changes in organization, role, and systems.
