Associate General Counsel - HIPAA, HITECH, and State Privacy Law The candidate applies knowledge of HIPAA, HITECH, and state law with sound business acumen and knowledge of the business goals and objectives as they relate to the legal matter at hand. Uses professional legal concepts and principles to contribute to the development of the company's concepts and principles. Must possess deep technical knowledge of HIPAA, HITECH, and state privacy law. Provides instructions to junior members in the Law and/or Privacy departments, along with concise, timely briefings to senior-level business and legal management. Routinely works on complex privacy problems in which analysis of situations and/or facts requires an in-depth evaluation of various factors. Serves as a resource for other attorneys and paralegals as well as business clients instructing and advising on technical and tactical issues. Assesses and mitigates privacy risk. Reports to management any identified business exposure and associated privacy risks as well as mitigation techniques being utilized.

The candidate requires a JD, a current license to practice law, and 9 years of experience with HIPAA and HITECH, as well as state privacy law, and/or related industry and/or technical legal experience post licensure. Experience managing outside counsel is strongly preferred. Experience providing legal counsel on complex HIPAA, HITECH, and state law privacy and security issues is preferred. Excellent written and oral communication skills, including experience drafting legal memos, HIPAA Business Associate Agreement negotiation skills, and the ability to effectively present information to and advise business teams and key business partners. Ability to work well both independently and as part of a team with a manager. Ability to exercise good professional judgment to support enterprise risk. Have a solid background in state and federal privacy laws, including a working knowledge of the HIPAA Privacy and Security rules, HITECH incident response, the California Consumer Protection Act ( CCPA ), and the California Privacy Rights Act ("CPRA"). GDPR experience is a plus. Certified Information Privacy Professional ("CIPP") certification or other comparable privacy professional certification (or willingness to obtain the same) is preferred. Demonstrated experience with HITECH and state privacy and security incident response, including counseling Information Security clients on legal obligations under state and federal law, and analyzing customer contracts to interpret privacy and security provisions is preferred. Capable of analyzing and assessing the impact of new or proposed privacy and security regulations, helping to interpret and apply existing laws and regulations in the diverse and dynamic firms' business environment. Participate in internal public policy discussions and serve as an internal expert on privacy and security legislation, guidance, and regulation affecting AI and machine learning, and support business efforts to plan and execute programmatic changes in response to enacted new laws and regulations. Prefer candidate with experience working with Health Plan clients in a company's Privacy, Corporate Compliance, Information Technology, and Information Security areas, as well as private support for client and vendor contracting, external audits, training, and communications.
