Claims Counsel Responsibilities: Will manage matters involving bad faith allegations or seek extra-contractual damages against company, including notification to Senior Claims Management and the Legal Department of potential Errors and Omissions exposure. Manage matters involving suits against the Company which involve underwriting and claims issues, regulatory issues or issues of importance to company, where we reasonably believe the claim will be amended to add a bad faith claim. Provide advice to claims examiners, managers and directors in the areas of coverage interpretation and coverage application; act as a resource to examiners, managers and directors in cases where declaratory judgment actions are recommended; review pleadings, affidavits, corporate disclosures and settlement agreements in suits involving the company; assist in reviewing and responding to policy limit demands; assist in deposition preparation. Provide technical guidance to examiners, managers and directors in complying with discovery requests; review potential rescission actions; participate in case conferences with examiners, managers, directors and /or underwriters to respond to changes in the legal environment; coordinate with corporate legal on matters of regulatory compliance; complete quarterly surveys on suits against the company; assist in reviewing responses to claims-related department of insurance complaints and/or civil remedy notices; presentations to claims and underwriting as requested; and assist with special projects as requested.

Qualification Requirements: A J.D. degree and admission to practice law in at least one state. 10+ years of coverage and litigation experience. Knowledge of first-party claims a plus. Significant experience in responding to policy limit demands. Excellent written and oral communication skills. Ability to manage multiple priorities. Ability to proactively self-manage high exposure cases. Ability to analyze and summarize complex issues; recognize alternative approaches and develop action plans, both orally and in written form.
