Corporate Attorney The candidate will collaborate with the business to review sales and marketing programs to ensure they are legally compliant with federal and state laws including FTC and e-commerce laws, regulations and marketing principles. Provide legal guidance on existing and new initiatives, including customer agreements, enhanced services, social media campaigns, payment technologies, as well as a wide variety of commercial arrangements supporting e-commerce, direct consumer and Carhartt Company Gear business to business sales programs. Advice on legal requirements for website enhancements through review and drafting of terms and conditions, customer notices, product disclosures, website content, customer loyalty programs including development and implementation of processes to manage legal compliance. Provide legal support to brick and mortar store operations including lease negotiations and guidance on applicable regulatory compliance requirements. Partner with the business to review promotions including contests, sweepstakes, partnerships and third-party collaborations. Collaborate with sales operations and vendor compliance teams as needed. Perform general legal research, review and counsel for projects?and strategic initiatives. Support the?company's approach toward litigation and other proceedings to which the company is a party or potentially a party.?Foster?effective relationships with external providers of legal services on an ongoing basis.?Collaborate?with the?General Counsel on compliance matters and enterprise risk?management.?Remain up-to-date on the relevant apparel industry, consumer protection and advertising laws and regulations.
The candidate should have a Bachelor's Degree. Should have J.D. Degree. Admission in good standing to the State Bar is required. Should preferably have 7?years of?corporate?and/or professional law experience and in-house counsel experience. Should have experience advising on marketing, e-commerce and consumer protection laws including antitrust requirements. Should have extensive knowledge of regulations and industry guidelines applicable to mobile, social media, and traditional marketing, including CAN-SPAM, COPPA, and the FTC Endorsement and Testimonial Guidelines. Should have ability to independently draft and negotiate complex commercial and technology agreements and policies, including partnership agreements, services agreements, and terms and conditions, experience working collaboratively with global and cross-functional teams and implementing new processes, ability to handle multiple projects simultaneously and efficiently resolve issues and recommend solutions that are legally sound and pragmatic, strong verbal and written communication skills including the ability to influence associates, leaders and cross-functional partners. Exposure to the apparel industry, retail and global manufacturing is preferred.?
