Daytona Beach FL Staff Counsel - Labor & Employment and General Corporate The candidate assists in the mitigation of legal risks to the Company in the areas of labor and employment law and general corporate practice. Provide advice and counsel to internal clients on employee rights and responsibilities regarding discipline, discharge, leave (e.g., ADA, FMLA and PTO), workers compensation and regulatory compliance. Corporate Attorney Duties: Reports to the General Counsel (GC) and is responsible for assisting with corporate strategic and tactical legal initiatives as assigned by the GC. Provides the GC with effective legal advice on company strategies and their implementation, and assists with the legal function. Assists with business transactions, reviewing contracts, and other legal functions as assigned. Partners with the firm s GC, other members of the legal department to help with risks and advance the company s vision and strategic plan. Leverages broad legal subject matter expertise with practical experience to assist in the legal areas of contracts; corporate and securities transactions; corporate governance; litigation; insurance, risk and dispute management; compliance; labor and employment; and employee benefits. Assist in all aspects of the legal functions of the company as assigned by GC. Provide counsel to the GC on a range of compliance, risk management, corporate governance and other matters. Provide practical legal advice and support across all Practices and Resource Groups, including reviewing, drafting and negotiating a diverse range of complex agreements, contracts, leases and other legal documents. Assist with resolving legal-related disputes with third parties, and managing outside litigation resources as assigned by the GC. Assist in ensuring compliance with all applicable U.S. and foreign laws and regulations and all client requirements. Assist with risk management, including advising regarding warranties and liabilities and risk management strategies to be implemented. Assist with legal advice to the GC regarding employee benefits plans and programs and their administration. Assist with the review legal related procedures, processes, and administration as assigned by the GC, recommending improvements to the systems in place and managing the systems going forward.

Qualifications: JD Degree and admission to the bar of the State of Florida. 4-6 years experience, including time with a law firm. Exceptional writing and communication skills; ability to convey legal advice clearly and effectively. Excellent legal and practical judgment with strong problem solving skills. Results-oriented, with a high sense of urgency and good time management skills. Must be flexible with the ability to manage multiple projects simultaneously. Excellent interpersonal skills & the ability to work effectively with employees at all levels. A collaborative and flexible style, with a strong service mentality.

Trial Attorney, Insurance Defense - Bodily Injury (Work at Home/Northeast Florida) The candidate within Bodily Injury unit, will be a member of insurance defense litigation team, providing legal representation to Progressive insureds and/or to the Progressive Insurance Companies before courts and arbitration panels in all aspects of litigation. Handling own cases from beginning to end, will also prepare legal pleadings, motions, statements, trial briefs and be involved in negotiating settlements. Work closely with customers and claims team to ensure all appropriate defenses are leveraged to reach positive outcomes. Will be managed remotely, but will be needed in the office periodically.

A Juris Doctorate (J.D.) from an accredited law school required. Active license to practice law in Florida required. 2 years of civil litigation experience required. Should have 3-7 years of civil litigation experience preferred including auto bodily injury insurance defense or plaintiffs personal injury. Must have listening, verbal and written communication skills. Should have ability to litigate and try cases. Must be capable of working independently and as a team member/ Should have ability to work with clients and customers. Must have ability to review and assess medical records, depositions and other documents. Time management and organizational skills are needed.

Assistant General Counsel (ERISA/Employee Benefits) The candidate will assist the company with the employee benefits programs and to coordinate activities of retained outside legal counsel. The candidate must have a J.D. degree from an ABA-approved law school and be an active member in good standing of a state bar association. At least five (5) years of sophisticated experience with tax-qualified retirement plans, executive compensation, equity compensation and welfare benefit plans. Must have expertise with laws and regulations dealing with employee benefits, executive compensation plans and the comprehensive federal law called the Employee Retirement Income Security Act of 1974 (which is known as "ERISA"). Should have experience in advising and counseling regarding ERISA and other laws that relate to employee benefits like health, disability and pension plans. Ability to work from the headquarters. Outstanding written and oral communication skills. Occasional travel will be required to office and meeting locations across the U.S. Public speaking skills are a must. Business acumen will be required and continuing education in the insurance brokerage arena will be expected.
