Jacksonville FL L&R - Insurance Operations Attorney The candidate, reporting to the General Counsel, will provide legal advice and counsel on behalf of company on moderately complex matters, including: federal and state regulatory requirements, contracting, policy administration, privacy, cyber security and information governance, risk management, litigation strategy, and new business initiatives. Lead Counsel - Litigation The candidate will be responsible for supervision and direction of nationwide litigation matters. Will review and analyze incoming lawsuits, regulatory complaints, and other pre-litigation matters. Select and supervise outside counsel and coordinate litigation strategy to resolve lawsuits and other disputes expeditiously and economically. Travel to and attend mediations, corporate depositions, and significant trials and hearings. Represent the company where appropriate in litigation and pre-litigation matters. Collaborate with company management and staff to minimize litigation risk and implement policies and procedures to avoid future litigation. Interact with and assist the Litigation Practice Group and the Legal Department on other matters and projects as needed.

The candidate must have 10 years of civil litigation experience in a top law firm and/or corporation, including considerable experience in all phases of trial practice. Should have Juris Doctorate degree from ABA accredited law school. Must be Licensed to practice law and a member in good standing of at least one State Bar, preferably Florida or Georgia. Should preferably have a significant background in insurance defense and coverage issues. Prefer candidates with 1st/2nd chair trial experience at Am Law 200 law firm. Should have stellar academic credentials, sound judgment, excellent communication skills, proven leadership, and track record of success.

Conduct preliminary trademark clearance of product names and campaign slogans. Investigate trademark and copyright infringements in LATAM and send cease and desist letter, if required. Conduct legal research for a variety of issues related to franchising and global projects. Drafting memoranda on issues presented. Should have JD degree. Working knowledge of case management tools is required. Must be bilingual (English and Spanish). Portuguese is a plus. Should have effective written and oral communication. Should have working understanding of applicable laws, regulations and guidelines including; FTC, COPPA, Sweepstakes and Promotions, Advertising. Knowledge of contract law including advertising law, franchise law, privacy law is a plus.

Collaborate with local counsel to advise Human Resources and management on international employment issues. Advise Human Resources and management to ensure compliance with US federal executive orders and Office of Federal Contract Compliance Programs (OFCCP) regulations. Manage employment related litigation, including responding to attorney demand letters, effectively negotiating resolution of claims, and making recommendations to Human Resources and senior management on corrective action. Actively monitor employment law changes, to ensure policies and practices are compliant.

The candidate should have a J.D. degree from an accredited law school. Must be a member in good standing of the Bar with 5 years of experience in employment law, or in a combination of employment and benefits law. Hands on experience representing clients before employment administrative agencies and/or state and federal courts is desired. Top-tier law firm and/or in-house experience in a public company is preferred.
