Senior Legal Counsel - Privacy

San Jose CA Senior Legal Counsel - Privacy The candidate to join Global Privacy and Data Protection legal team. Will provide world-class privacy and data protection legal advice as a member of the Global Legal Privacy team, reporting to companys Global Legal Head - Privacy and Data Protection. Will work closely with legal colleagues who support company in more than 200 markets around the world as part of a growing legal team, currently comprised of approximately 175 legal staff members globally. Serve as a key subject matter expert and advisor to company lawyers and business units on privacy and data protection issues in commercial negotiations. Draft and negotiate the privacy and data protection aspects of complex agreements ranging from professional services, development, and supplier agreements with various merchants, partners and vendors. Advise company Human Resources (HR) senior leaders and operational teams on matters involving the processing of employee personal data to help maintain compliant privacy and data protection practices across the global HR function. Support the Global Privacy Office in the continued development and implementation of the Data Privacy Impact Assessment program. Advise on new and emerging legal and regulatory developments impacting data privacy and data security, including identifying trends and potential impacts on business activities. Understand and advise on the privacy and data protection legal requirements applicable to complex data flows across the data lifecycle. Collaborate and coordinate with government relations teams to proactively monitor and review privacy and data-protection related legislation in order to help ensure accurate and up-to-date inventories of all legal obligations.

The candidate should have Juris Doctorate or equivalent degree. Admitted to a state Bar is required. Should have 7+ years of experience practicing either in-house (or in an equivalent setting) or at a reputable law firm. Must have deep, demonstrable privacy, data protection, and program management skills and expertise, with an emphasis on financial and/or employee privacy laws. Specific experience with privacy and data protection laws, including GLBA, CCPA, LGPD, CAN-SPAM, HIPAA, GDPR, e-Privacy Directive, and other applicable laws is required. Day-to-day responsibilities Include: Lead projects to support corporate governance efforts that include Board support and intercompany governance support.
